CUTTING AND PATCHING OF WORK. 4.14.1 The Contractor shall be responsible for all cutting, fitting or patching that may be required to complete the Work or to make its several parts fit together properly. 4.14.2 The Contractor shall not damage or endanger any portion of the Work or the work of the State or any separate contractors by cutting, patching or otherwise altering any work, or by excavation. The Contractor shall not cut or otherwise alter the work of the State or any separate contractor except with the written consent of the State and of such separate contractor. The Contractor shall not unreasonably withhold from the State or any separate contractor his consent to cutting or otherwise altering the Work.

CUTTING AND PATCHING OF WORK. 3.19.1 The Construction Manager shall be responsible for all cutting, fitting, or patching that may be required to complete the Work or to make its several parts fit together properly. 3.19.2 The Construction Manager shall not damage or endanger any portion of the Work or the work of the Principal Representative or any separate contractors by cutting, patching, or otherwise altering any work, or by excavation. The Construction Manager shall not cut or otherwise alter the Work of the Principal Representative or any separate contractor except with the written consent of the Principal Representative and of such other contractor. No required consents shall be unreasonably withheld.

Any costs resulting from improper cutting, fitting and patching to any work performed by Owner or any other contractors to Owner shall be Contractor’s responsibility. Contractor shall not damage or endanger a portion of the Work or fully or partially completed construction of Owner or separate contractors by cutting, patching or otherwise altering such construction, or by excavation. Contractor shall not cut or otherwise alter such construction by Owner or a separate contractor except with consent of Owner and of such separate contractor. Contractor, if required by Specifications and Drawings, shall make connections to materials or equipment furnished, set, and/or installed by other contractors. No Work connecting to such materials or equipment provided by other contractors shall be done without giving such contractors a reasonable length of time to complete their work or until permission to proceed has been obtained from Owner. Owner shall secure and provide to Contractor the Shop Drawings from Owner’s other contractors for such of their work as is to be built into Contractor’s Work, or to which Contractor must make connection, and Contractor shall review and advise Owner of any discrepancy or unsuitability relative to its own Work. Each contractor shall provide all openings and chases in its own work, necessary for the installation of process equipment, and shall fill in around the same afterwards, if required.

The Contractor shall not unreasonably withhold from the Owner or any separate contractor its consent to cutting or otherwise altering the Work. 5.10.3 Structural elements of the Work shall not be cut, patched or otherwise altered or repaired without prior written authorization by the Owner. 5.10.4 Authorization to proceed with remedial operations for any damaged or defective element or portion of the Work shall not constitute a limitation or a waiver of the Contractor's right to require the removal and replacement of any Work which fails to fulfill the requirements of the Contract Documents.

Openings shall be neatly cut and shall be kept as small as possible to avoid unnecessary damage. Careless and/or avoidable cutting damage, etc., will not be tolerated, and the Contractor will be held responsible for such avoidable or willful damage. Protect adjacent occupied spaces, roof membranes, and building envelope systems from damage during concrete cutting and coring. 4.14.5 All replacing, patching and repairing of all materials and surfaces cut or damaged in the execution of the Work shall be performed by experienced mechanics of the several trades involved. Such replacing, repairing or patching shall be done with the applicable materials, in such a manner that all surfaces so replaced, etc., will, upon completion of the Work, match the surrounding similar surfaces. 4.14.6 The Contractor is to provide notification to the County of impending work near all existing facilities, including site work and renovation work in the existing facility if applicable. This will be noted as part of the Contractor’s three week look ahead schedule submitted at weekly progress meetings with the County. 4.14.7 Patching shall successfully duplicate undisturbed adjacent finishes, colors, textures, and profiles.
