Common use of Daily Employment Clause in Contracts

Daily Employment. a) Except as provided in 8.2, employment will be daily hire. Any Employee not specifically engaged as a casual employee will be deemed to be employed by daily hire. b) The following provisions will apply to daily hire employees: (i) One day’s notice of termination of employment will be given by either party or one day’s pay must be paid or forfeited; (ii) Notice given at or before the usual starting time of any ordinary working day will expire at the completion of that day’s work; (iii) A tradesperson will be allowed one hour prior to termination to gather, clean, sharpen, pack and transport tools; and (iv) Nothing in this clause will affect the right of an employer to dismiss an employee without notice for misconduct or refusing duty.
