Data Breach or Loss. (a) The Contractor shall comply with all applicable data protection, data security, data privacy and data breach notification laws, including but not limited to the Breach of Personal Information Notification Act, as amended November 22, 2022, P.L. 2139, No. 151, 73 P.S. §§ 2301—2330. Further, to the extent the Contractor maintains, stores, or manages computerized data on behalf of the Commonwealth that constitutes personal information, as defined in the Breach of Personal Information Notification Act, the Contractor shall comply with the then current version of the following IT Policies (ITPs): ITP-SEC019, Policy and Procedures for Protecting Commonwealth Electronic Data; ITP-SEC024, IT Security Incident Reporting Policy; ITP-SEC025, Proper Use and Disclosure of Personally Identifiable Information (PII); and ITP-SEC031, Encryption Standards.

Data Breach or Loss. To the extent the Licensor receives, provides, stores, manages, maintains, and/or transmits personal information including, but not limited to, personal health information, pursuant to this Contract, the Licensor shall comply with all applicable data protection, data security, data privacy and data breach notification laws, including but not limited to the Breach of Personal Information Notification Act, as amended November 2, 2022, P.L. 2139, No. 151, 73 P.S. §§ 2301—2330. Further, to the extent the Licensor maintains, stores, or manages computerized data on behalf of the Commonwealth that constitutes personal information, as defined in the Breach of Personal Information Notification Act, the Licensor shall comply with the then current version of the following IT Policies (ITPs): ITP-SEC019, Policy and Procedures for Protecting Commonwealth Electronic Data; ITP-SEC024, IT Security Incident Reporting Policy; ITP-SEC025, Proper Use and Disclosure of Personally Identifiable Information (PII); and ITP-SEC031, Encryption Standards.

  • Data Breach In the event of an unauthorized release, disclosure or acquisition of Student Data that compromises the security, confidentiality or integrity of the Student Data maintained by the Provider the Provider shall provide notification to LEA within seventy-two (72) hours of confirmation of the incident, unless notification within this time limit would disrupt investigation of the incident by law enforcement. In such an event, notification shall be made within a reasonable time after the incident. Provider shall follow the following process:

  • BREACH; TERMINATION Failure of either party to comply substantially with any material provision hereof is a breach of the Lease. Should Tenant neglect or fail to perform and observe any of the terms of this Lease, Landlord shall give Tenant written notice of such breach requiring Tenant to remedy the breach or vacate the Premises on or before a date at least 5 days after the giving of such notice, and if Tenant fails to comply with such notice, Landlord may declare this tenancy terminated and institute action to expel Tenant from the leased Premises without limiting the liability of Tenant for the rent due or to become due under this Lease. If Tenant has been given such notice and has remedied the breach or been permitted to remain in the Premises, and within one year of such previous breach, Tenant commits a similar breach, this Lease may be terminated if, before the breach has been remedied, Landlord gives notice to Tenant to vacate on or before a date at least 14 days after the giving of the notice as provided in sec. 704.17

  • Breach A breach of the contract clauses above may be grounds for termination of the contract, and for debarment as a contractor and subcontractor as provided in 29 C.F.R. § 5.12.
