Common use of De-identified Information Clause in Contracts

De-identified Information. Business Associate may use and disclose de-identified health information if (i) the de-identification is in compliance with 45 CFR §164.502(d); and (ii) the de-identified health information meets the standard and implementation specifications for de-identification under 45 CFR §164.514(a) and (b).

De-identified Information. Business Associate may use and disclose de-identified health information if (i) the use is disclosed to Covered Entity and permitted by Covered Entity in its sole discretion and (ii) the de-identification is in compliance with 45 CFR C.F.R. §164.502(d); , and (ii) the de-identified health information meets the standard and implementation specifications for de-identification under 45 CFR C.F.R. §164.514(a) and (b).

De-identified Information. Business Associate may use and disclose de-de- identified health information if (i) the de-use is disclosed to Covered Entity and permitted by Covered Entity in its sole discretion and (ii) the de- identification is in compliance with 45 CFR C.F.R. §164.502(d); , and (ii) the de-de- identified health information meets the standard and implementation specifications for de-identification under 45 CFR C.F.R. §164.514(a) and (b).

Business Associate may use and disclose de-de- identified health information information, if (i) the de-use is disclosed to Covered Entity and permitted by Covered Entity in its sole discretion and (ii) the de- identification is in compliance with 45 CFR C.F.R. §164.502(d); , and (ii) the de-de- identified health information meets the standard and implementation specifications for de-identification under 45 CFR C.F.R. §164.514(a) and (b)) together with any other component of the Privacy Rule.

Business Associate may use and disclose de-identified deidentified health information information, if (i) the de-identification use is disclosed to Covered Entity and permitted by Covered Entity in its sole discretion and (ii) the deidentification is in compliance with 45 CFR C.F.R. §164.502(d); , and (ii) the de-identified deidentified health information meets the standard and implementation specifications for de-identification under 45 CFR C.F.R. §164.514(a) and (b)) together with any other component of the Privacy Rule.

De-identified Information. Business Associate may use and disclose de-identified health information if (i) the intended use is for the proper internal management and administration of Business Associate, and (ii) the de-identification is in compliance with 45 CFR C.F.R. §164.502(d); ) and (ii) the de-identified health information meets the standard and implementation specifications for de-identification under 45 CFR C.F.R. §164.514(a) and (b)) and guidance issued thereafter by HHS.

De-identified Information. Business Associate may use and disclose de-identified de‐identified health information if (i) the de-identification use is disclosed to Covered Entity in writing and permitted in writing by Covered Entity in its sole discretion and (ii) the de‐identification is in compliance with 45 CFR §164.502(d); , and (ii) the de-identified de‐identified health information meets the standard and implementation specifications for de-identification de‐identification under 45 CFR CRF §164.514(a) and (b).

De-identified Information. Business Associate may use and disclose de-de- identified health information information, if (i) the de-use is disclosed to Covered Entity and permitted by Covered Entity in its sole discretion and (ii) the de- identification is in compliance with 45 CFR C.F.R. §164.502(d); , and (ii) the de-de- identified health information meets the standard and implementation specifications for de-identification under 45 CFR C.F.R. §164.514(a) and (b).

Business Associate may use and disclose de-identified health information information, if (i) the use is disclosed to Covered Entity and permitted by Covered Entity in its sole discretion, (ii) the de-identification is in compliance with 45 CFR C.F.R. §164.502(d); , and (ii) the de-de- identified health information meets the standard and implementation specifications for de-de- identification under 45 CFR C.F.R. §164.514(a) and (b).

De-identified Information. Business Associate may use and or disclose protected health information that has been de-identified health information if (i) in accordance with the de-identification is in compliance with standards set forth at 45 CFR §164.502(d); and (ii) the de-identified health information meets the standard and implementation specifications for de-identification under 45 CFR C.F.R. §164.514(a) and ), (b), and (c ).

De-identified Information. Business Associate may use Use and disclose Disclose de-identified health information information, if (i) the de-identification is in compliance with 45 CFR §164.502(d); , and (ii) the de-de- identified health information meets the standard and implementation specifications for de-de- identification under 45 CFR §164.514(a) and (b), as well as the Guidance on De-Identification of PHI issued by the Secretary on November 26, 2012, and any updates to such guidance.

De-identified Information. Business Associate may use and disclose de-identified health information if (i) the use is disclosed to Covered Entity and permitted by Covered Entity in its sole discretion and (ii) the de-identification is in compliance with 45 CFR C.F.R. §164.502(d); , and (ii) the de-identified health information meets the standard and implementation specifications for de-identification under 45 CFR C.F.R. §164.514(a) and (b)) and the dates of birth and zip codes of individuals in the de-identified population are also excluded.

De-identified Information. Business Associate may use and disclose de-identified health information if (i) the de-use is disclosed to the Plan and permitted by law and (ii) the de- identification is in compliance with 45 CFR §164.502(d); ) and (iiiii) the de-identified health information meets the standard and implementation specifications for de-identification under 45 CFR §164.514(a) and (b).

De-identified Information. Business Associate may use and disclose de-de- identified health information if (i) the use is disclosed to Covered Entity and permitted by Covered Entity in its sole discretion and (ii) the de-identification is in compliance with 45 CFR C.F.R. §164.502(d); , and (ii) the de-identified health information meets the standard and implementation specifications for de-de- identification under 45 CFR C.F.R. §164.514(a) and (b).

De-identified Information. Business Associate may use and disclose de-identified health information if (i) the de-use is disclosed to Covered Entity and (ii) the de- identification is in compliance with 45 CFR §164.502(dC.F.R. h164.502(d); , and (ii) the de-identified health information meets the standard and implementation specifications for de-de- identification under 45 CFR §164.514(aC.F.R. 9164.514(a) and (b)) and the dates of birth and zip codes of individuals in the de-identified population are also excluded.
