Debt Service Reserve Account Contract. Notwithstanding any other provision hereof or of any Supplemental Indenture, any Debt Service Reserve Account may be funded with, and any cash, Permitted Investments or other funding vehicle on deposit in any Debt Service Reserve Account may be withdrawn and replaced with, a surety bond, insurance policy, letter of credit, investment agreement, investment contract or similar instrument (a ―Debt Service Reserve Account Contract‖) that provides for payments when and as required for purposes of such Debt Service Reserve Account and is issued by an obligor whose obligations such as the Debt Service Reserve Account Contract are, when such contract is deposited into such Debt Service Reserve Account, rated in one of the two highest generic rating categories by each Rating Agency. Any moneys withdrawn from any Debt Service Reserve Account in connection with the deposit of a Debt Service Reserve Account Contract therein shall be deposited into any Account included in the Trust Estate, except the System Surplus Account, as directed by the Transportation Enterprise.
