Deemed Abandonment. Failure of the breaching Party to appoint such a representative within the thirty (30) day period shall be deemed a withdrawal or abandonment of the Dispute by the breaching Party and the arbitrator shall render a formal decision, finding in favour of the non-breaching Party.

Deemed Abandonment. If the rented premises are vacant on the rental due date and no payment of rent has been received by the LANDLORD, it shall be presumed that the TENANT has abandoned the rented premises and the LANDLORD shall be entitled to regain immediate possession of the rented premises in accordance with the Residential Tenancies Act, including removal of the TENANT’s mobile home at the TENANT’s expense.
Deemed Abandonment. The Work may, in the sole discretion of the City, be deemed abandoned, if, after commencement of the Work, the Contractor fails to have workmen on the site for ten (10) consecutive days. Any days that the City Representative determines should not be a workday solely because of weather conditions shall not be counted as days. The work shall not be deemed to be abandoned until the first to occur of the following: written notice of abandonment is given by the Contractor to the City; the City gives the Contractor written notice that the Contractor has, pursuant to the terms of this Agreement, abandoned the work; or, if applicable, the City receives written notice that the Contractor has filed for bankruptcy.
