Common use of Deemed receipt Clause in Contracts

Deemed receipt. A notice, request, certificate, demand, consent or other communication under this Agreement is deemed to have been received: (a) (DELIVERY): where delivered in person, upon receipt; (b) (POST): where sent by post within Australia, on the 3rd day after posting and where sent by post to, from or outside Australia, on the 7th day after posting; (c) (FAX): where sent by facsimile, on production by the dispatching facsimile machine of a transmission report which indicates that the facsimile was sent in its entirety to the facsimile number of the recipient; and (d) (EMAIL): where sent by email, on the date the email is received. However, if the time of deemed receipt of any notice is not before 5.30 pm on a Business Day at the address of the recipient it is deemed to have been received at the commencement of business on the next Business Day.
