Common use of Deemed receipt Clause in Contracts

Deemed receipt. A notice, request, certificate, demand, consent or other communication under this Agreement is deemed to have been received: (a) (Delivery): where delivered in person, upon receipt; (b) (Post): where sent by post, on the 3rd (7th if outside Australia) day after posting; (c) (Fax): where sent by facsimile, on production by the dispatching facsimile machine of a transmission report which indicates that the facsimile was sent in its entirety to the facsimile number of the recipient; and (d) (Email): where sent by email, on the date that the email is received. However, if the time of deemed receipt of any notice is not before 5.30 p.m. local time on a Business Day at the address of the recipient it is deemed to have been received at the commencement of business on the next Business Day.
