Common use of Defective Equipment Clause in Contracts

Defective Equipment. _L The Employer shall not require any employee to operate, nor shall any employee operate, any equipment that is not in safe operating condition or not in accordance with operator or safety manuals or procedures. It is not a violation o f this agreement where such employees refuse to operate such equipment due to a reasonable belief that the equipment is not in safe operating condition, noting that employees must notify the Highway Superintendent or designee as soon as possible.
