Defined Terms and Other Provisions of General Application. (a) Capitalized terms used but not otherwise defined herein shall have the respective meanings assigned them in Part I of Appendix A to the Pooling and Servicing Agreement, dated as of the date hereof, among the Issuing Entity, the Depositor and the Servicer, as it may be amended, supplemented or modified from time to time, and all other terms used herein which are defined in the Trust Indenture Act or by Commission rule under the Trust Indenture Act or in the Series Supplement, either directly or by reference therein, have the meanings assigned to them therein. All references herein to “the Indenture” or “this Indenture” are to this Indenture as it may be amended, supplemented or modified from time to time, the exhibits hereto and the capitalized terms used herein which are defined in such Appendix A, and all references herein to Articles, Sections and subsections are to Articles, Sections or subsections of this Indenture unless otherwise specified. The Rules of Construction set forth in Part II of such Appendix A shall be applicable to this Indenture.
