DEFINED TERMS, INTERPRETATION AND MISCELLANEOUS. In this Agreement and the Contract, unless the context otherwise requires:
A. Each of the acronyms, abbreviations and terms have the meaning given in Section 1 of the General Conditions;
B. The words “including,” “includes” and “include” will be read as if followed by the words “without limitation”;
C. The meaning of “or” will be that of the inclusive “or,” that is meaning one, some or all of a number of possibilities;
D. A reference to any party or Person includes each of their legal representatives, trustees, executors, administrators, successors, and permitted substitutes and assigns, including any Person taking part by way of novation;
E. A reference to any Governmental Body, institute, association or body is:
1. If that Governmental Body, institute, association or body is reconstituted, renamed or replaced or if the powers or functions of that Government Body, institute, association or body are transferred to another organization, a reference to the reconstituted, renamed or replaced organization or the organization to which the powers or functions are transferred, as applicable; and
2. If that Governmental Body, institute, association or body ceases to exist, a reference to the organization which serves substantially the same purposes or objectives as that Governmental Body, institute, association or body;
F. A reference to this Agreement or the Contract or to any other deed, agreement, document or instrument includes a reference to this Agreement or the Contract or such other deed, agreement, document or instrument as amended, revised, supplemented or otherwise modified from time to time;
G. A reference to any legislation or to any section or provision of it includes any amendment to or re-enactment of, or any statutory provision substituted for, that legislation, section or provision;
H. A reference to this Agreement or the Contract includes all Schedules, Appendices and Exhibits;
I. A reference to an Article, Section, Schedule, Appendix or Exhibit is a reference to an Article, Section, Appendix or Exhibit of the document in which it occurs;
J. Where any word or phrase is given a defined meaning, any other part of speech or other grammatical form of that word or phrase has a corresponding meaning;
K. A reference to time is a reference to Pacific Time Zone in the United States;
L. No rule of construction applies to the disadvantage of a party on the basis that the party put forward or drafted the Contract or any part; and
