Definition of Earned Income. For purposes of making the cost of living adjustment described above, a Party’s “earned income” shall equal the total of all “earned income” as that term is defined in Section 32(c)(2)(a) of the Internal Revenue Code (as amended from time to time), without deduction for retirement savings, payroll taxes, or other deductions, and shall include any contribution by an employer to a Party’s retirement accounts and any cafeteria-plan payments that are excluded from W-2 wages.   • Definition of Total Disability Total disability means that the employee is unable, because of sickness or accident, to perform the duties of their regular occupation. This definition applies for the first twenty-four (24) months of payments. After this time, the inability to perform an occupation for which the employee is reasonably fitted by training, education or experience will constitute total disability. It is not required that an employee be confined to home, but they must be under the regular care of a physician.

  • Definition of Sick Leave Sick leave means the period of time an Employee is absent from work because of disability due to illness or injury not covered by Workers’ Compensation.

  • COMPUTATION OF BACK WAGES No claim for back wages shall exceed the amount of wages the employee would otherwise have earned at the employee's regular rate less:

  • DEFINITION OF EMPLOYEE STATUS AND BENEFIT ENTITLEMENT For the purpose of this Article “regularly scheduled” means any combination of shifts scheduled in advance and issued by the Employer.
