Delegation of Authority; Transfer of Records, Accounts, Funds and Property. Beginning on the Commencement Date, as defined in Section 2.10, each of the Member Agencies shall have entered into an agreement with the Department for the Department’s use of the Member Agency’s Joint Facilities within its territorial jurisdiction, which agreement, as may be amended from time to time, shall remain in place while the Member Agency is a party to this Agreement and receiving services from the Department.

Delegation of Authority; Transfer of Records, Accounts, Funds and Property. Each of the Member Agencies has delegated to the Department the power and duty to maintain, operate, manage and control all of the Joint Facilities of each of the respective Member Agencies within their territorial jurisdictions, as well as those a Member Agency or the Department may acquire in the future. Further, the Member Agencies have delegated to the Department the authority to employ the necessary personnel and to do any and all other things necessary or desirable to provide continued, efficient, and economical Fire, and Emergency Medical Services to the Service Area.

  • Audit Rights Period for Construction-Related Accounts and Records Accounts and records related to the design, engineering, procurement, and construction of Connecting Transmission Owner’s Attachment Facilities and System Upgrade Facilities and System Deliverability Upgrades shall be subject to audit for a period of twenty-four months following Connecting Transmission Owner’s issuance of a final invoice in accordance with Article 12.2 of this Agreement.

  • Retention of Records The Contractor and its subcontractors shall maintain all records pertinent to this Agreement, and all other financial, statistical, property, participant records, and supporting documentation for a period of no less than seven (7) years from the later of the date of acceptance of the final payment or until all audit findings have been resolved. If any litigation, claim, negotiation, audit or other action involving the records has been started before the expiration of the retention period, the records shall be retained until completion of the action and resolution of all issues which arise from it, or until the end of the seven (7) years, whichever is later, and until any outstanding litigation, audit, or claim has been fully resolved.
