The damages specified in the sections titled Termination for Default and Retention of Records are not consequential, incidental, indirect, or special damages as that term is used in this section.
If an examination or audit undertaken pursuant to the Retention of Records, Audit, and Reports provision for LADWP reveals that LADWP overpayment to the contractor is more than five percent of the billings reviewed, the contractor shall pay all expenses and costs incurred by the Authorized Auditors arising out of or related to the examination or audit.
