The Commonwealth agrees to assess the proposed projects and/or activities on a State-by-State basis for inclusion as part of bilateral schedules to this Agreement in accordance with the Assessment Guidelines set out in this Appendix. The State Minister will provide to the Commonwealth Minister a list of proposed project(s) and/or activities for the term of this Agreement which may contain the following details: the estimated costings and completion date for each activity under each project or activity; the proposed funding required to achieve each project or activity (including details of proposed Commonwealth, State, third party and other contributions, where relevant); relevant outcomes for each project or activity; a description of the selection process for each project and/or rationale to support the activity; a description of the methods adopted to design and implement and, where necessary, justification for the particular approach taken; and how the proposed works contribute to one or more of the outputs at Part 2 – Project Outputs. States may include cash and contributions in estimating the cost of each proposed project. Only direct costs associated with the Improving Great Artesian Basin Drought Resilience program are acceptable as such contributions. Administration items incurred and salaries and wages for officers spending less than 20 per cent of their time on the program, should not be included. In considering whether to agree to the list of proposed projects or activities submitted by the State, the Commonwealth Minister will take into account for each project: consistency with the project eligibility criteria in this Appendix and the outputs of this Agreement; the transparency and equity of the process used to select projects; the ‘value for money’ of the projects, having particular regard to the cost of each proposed project compared to the water estimated to be saved for the environment and the degree of protection to high value natural springs afforded by such a project; and the amount of funding available each financial year for the proposed project(s) and/or activities. Should the Commonwealth agree to the proposed project, payments will be made on a matched basis subject to the State achieving milestones specified in the bilateral schedules to this Agreement. States will provide evidence in each annual performance report as to how the requirements of clauses A5 and A9 have been given effect. Project eligibility criteria Projects and activities that are eligible for funding under the program include: rehabilitation or replacement of ageing, legally-operated bores which are in an uncontrolled state with controlled bores and efficient watering system infrastructure particularly where such works will achieve significant and quantifiable environmental benefit or avoid significant and quantifiable environmental degradation; rehabilitation or replacement of bores where there has been a critical failure of infrastructure assets previously rehabilitated under earlier programs jointly funded by the Parties, due to the impact of highly corrosive water or a generic failure of technology not due to poor workmanship or for the payment of normal maintenance costs; decommissioning of old bores where the state governments have implemented new regulatory responses that require landholders to manage their own assets; project management costs, audits of works, marketing and promotional material for the program; and compliance programs that assist state agencies to implement new Great Artesian Basin water management arrangements; activities to encourage landholders to adopt best practice approaches to maintaining water extraction and distribution infrastructure including education and communication activities which assist in minimising the wastage of water and increase water pressure; and undertaking studies that assist with the development and implementation of new water management arrangements within the Great Artesian Basin. All projects under clauses A8(a), (b) and (c) must have a water meter or pressure monitoring device. Any new water meter that is installed must be pattern approved (by the meter manufacturer or supplier) in accordance with requirements of the National Measurement Institute and installed and operated in accordance with ATS 4747 of Standards Australia. At least 70 per cent of the estimated water savings from an infrastructure project under clauses A8(a), (b) and (c) will be directed to restoring pressure to the formation in which it is saved in the Basin and must not be reallocated by the States for consumptive purposes. All projects under clauses A8(a), (b) and (c) require third party financial contributions. States may determine the quantum of third party contributions required for eligibility under this clause.

The State has cooperated in arrangements for Basin Plan environmental watering, as measured by: Except as otherwise agreed between the Commonwealth and the relevant State(s) to facilitate improved environmental watering, confirmation that the characteristics of licensed entitlements held for environmental use have not been enhanced or diminished relative to like entitlements held and used for other purposes; and Where feasible and agreed by the relevant Basin State, and where associated third party impacts have been considered, confirmation that measures have been implemented to facilitate the use of environmental water by protecting environmental water in-stream and on land through: (i) the delivery of held environmental water in-stream though arrangements such as water shepherding to facilitate environmental flows; and (ii) further use of environmental water at multiple locations along the river, such as through return flow provisions; and confirmation that the Authority has been provided with annual environmental watering priorities, consistent with the Basin Plan; and confirmation that the management and delivery of planned and held environmental water is consistent with the Basin Plan; including: the environmental watering plan’s Principles to be applied to environmental watering; and that a State-by-State basis statement of reasons has been provided to the Authority for inclusion as part of bilateral schedules to this Agreement any environmental watering undertaken that was not in accordance with the Assessment Guidelines set out Basin annual environmental watering priorities; and confirmation that environmental watering in this Appendixregulated catchments has occurred having regard to the views of local communities and persons materially affected by the management of environmental water; and 12 months after the Authority has made the Basin-wide Environmental Watering Strategy, or within another timeframe agreed between the Authority and Basin State, confirmation that long-term environmental watering plans for surface water resource plan areas have been developed consistent with the requirements of the Basin Plan; and 5. For New South Wales, Victoria and South Australia only, the State has provided a brief description of supply measure projects for which feasibility and business cases are being developed for consideration under the SDL adjustment mechanism. By 31 August 2014, 2015, 2016, 2017, 2018 and 2019 (or first working day thereafter) 6. The State Queensland Minister will provide to the Commonwealth Minister a list of proposed project(s) and/or activities projects for the term of this Agreement which may contain the following detailsdetails of each project including: the estimated costings and completion date for each activity under each project or activityproject; the proposed funding required formulas to achieve be applied to each project or activity (including details of proposed Commonwealth, StateQueensland, third party and other contributions, where relevant); relevant outcomes for each project or activity(for example, estimated water savings, expected improvement in water pressure near Basin-dependant springs); a description of the selection process for each project and/or rationale to support project, including the activitymethod by which the voluntary interest of eligible third parties for assistance under the Program has been called for and assessed; and a description of the methods adopted to design and implement each project and, where necessary, justification for the particular approach taken; and how the proposed works contribute to one or more of the outputs at Part 2 – Project Outputs. States Queensland may include cash and in-kind contributions in estimating the cost of each proposed project. Only direct costs associated with the Improving Great Artesian Basin Drought Resilience program IGABIIP are acceptable as such contributions. Administration items incurred and salaries and wages for officers spending less than 20 per cent of their time on the programIGABIIP, should not be included. In considering whether to agree to the list of proposed projects or activities submitted by the StateQueensland, the Commonwealth Minister will take into account for each project: consistency with the project eligibility criteria in this Appendix Schedule and the outputs of this Agreement; the transparency and equity of the process used to select projects; the ‘value for money’ of the projects, having particular regard to the cost of each proposed project compared to the water estimated to be saved for the environment and the degree of protection to high value natural springs afforded by such a project; and the amount of funding available each financial year for the proposed project(s) and/or activitiesthis purpose. Should the Commonwealth agree to the proposed projectproject (proposed projects in Schedule B of this Agreement), payments will be made on a matched basis subject to the State achieving milestones specified in the bilateral schedules to this Agreementoutcome delivery. States Queensland will provide evidence in each annual a performance report at the conclusion of the project as to how the requirements of clauses A5 and A9 have been given effect. Project eligibility criteria Projects and activities that are eligible for funding under the program IGABIIP include: rehabilitation or replacement of ageing, legally-operated old bores which are legally operating in an uncontrolled state with controlled bores and efficient efficient, controlled watering system infrastructure systems, particularly where such works will achieve significant and quantifiable environmental benefit maintain or avoid significant and quantifiable environmental degradationimprove the flow of water to high value GAB-dependant springs; rehabilitation or replacement of bores where there has been a critical failure of infrastructure assets previously rehabilitated under earlier programs jointly funded by the Parties, due to the impact of highly corrosive water areas or a generic failure of technology not due to poor workmanship or for the payment of but not including normal maintenance costs; decommissioning of old bores where the state governments have implemented new regulatory responses that require landholders to manage their own assets; project management costs, audits of works, marketing and promotional material for the program; and compliance programs that assist state agencies to implement new Great Artesian Basin water management arrangements; activities to encourage landholders to adopt best practice approaches to maintaining water extraction and distribution infrastructure including education including: audits of completed works, compliance activities, project management costs and communication activities which assist in minimising marketing and promotional material for the wastage of water and increase water pressure; and undertaking studies that assist with the development and implementation of new water management arrangements within the Great Artesian Basinprogram. All projects under clauses A8(a), (b) and (cb) must have a water meter or pressure monitoring device. Any new water meter that is installed must be pattern approved (by the meter manufacturer or supplier) in accordance with requirements of the National Measurement Institute and installed and operated in accordance with ATS 4747 of Standards Australia. At least 70 per cent of the estimated water savings from an infrastructure each project under clauses A8(a), (b) and (cb) will be directed to restoring pressure to the formation in which it is saved in the Basin and must not be reallocated by the States Queensland for consumptive purposes. All projects under clauses A8(a), (b) and (cb) require third party financial contributions. States Queensland may determine the quantum of third party contributions required for eligibility under this clause.. To access HomeBuilder, owner-occupier applicants must: be a natural person (not a company or trust); be aged 18 years or older on the States contract date; be an Australian citizen; be below one of the following two income caps: $125,000 per annum for an individual applicant based on their 2018-19 taxable income or later; or $200,000 per annum for a couple based on their combined 2018-19 taxable income or later. be within one of the following price caps: for contracts entered into on or after 4 June 2020 up to and including 31 December 2020 to either: build a new home as a principal place of residence, where the property value (i.e. house and land) does not exceed $750,000; or substantially renovate an existing home as a principal place of residence, where the renovation contract is greater than $150,000 and does not exceed $750,000, and where the value of the existing property (i.e. house and land, before renovation) does not exceed $1.5 million; or for contracts entered into on or after 1 January 2021 up to and including 31 March 2021 to either: build a new home as a principal place of residence, where the property value (i.e. house and land) does not exceed: $950,000 if the dwelling is in preparing New South Wales; $850,000 if the dwelling is in Victoria; or $750,000 in all other States; substantially renovate an existing home as a list principal place of residence, where the renovation contract is greater than $150,000 and does not exceed $750,000, and where the value of the existing property (i.e. house and land, before renovation) does not exceed $1.5 million. Construction pursuant to the contract must commence within six months of the contract date. This requirement applies to all contracts signed on or after 4 June 2020 up to and including 31 March 2021. With regards to the definition of an owner‑builder, this is intended to mean a person who takes responsibility for domestic building work carried out on their own land/property. Investment properties are not eligible under HomeBuilder. Construction must be undertaken by a registered or licensed building service 'contractor' who is named as a builder on the Improving Great Artesian Basin Drought Resilience programbuilding licence or permit. In negotiating the contract, the parties must deal with each other at arm’s length. This means the contract must be made by two parties freely and independently of each other, and without some special relationship, such as being a relative. The terms of the contract should be commercially reasonable and the contract price should not be inflated compared to the fair market price. HomeBuilder is non-taxable in the hands of the owner-occupier, consistent with existing First Home Owner Grant programs. Applications for contracts signed on or after 4 June 2020 up to and including 31 March 2021 must be submitted to the relevant State authority by no later than 14 April 2021. The Commonwealth agrees will have the discretion to assess extend the proposed projects and/or activities on a State-by-State basis for inclusion as part of bilateral schedules to this Agreement in accordance with the Assessment Guidelines set out in this Appendixapplication deadline. The State Minister will provide to the Commonwealth Minister a list of proposed project(s) and/or activities for the term of this Agreement which may contain the following details: the estimated costings and completion date for each activity under each project or activity; the proposed funding required to achieve each project or activity (including details of proposed Commonwealth, State, third party and other contributions, where relevant); relevant outcomes for each project or activity; a description of the selection process for each project and/or rationale to support the activity; a description of the methods adopted to design and implement and, where necessary, justification for the particular approach taken; and how the proposed works contribute to one or more of the outputs at Part 2 – Project Outputs. States may include cash and contributions in estimating the cost of each proposed project. Only direct costs associated with the Improving Great Artesian Basin Drought Resilience program are acceptable as such contributions. Administration items incurred and salaries and wages for officers spending less than 20 per cent of their time on the program, should not be included. In considering whether to agree to the list of proposed projects or activities submitted by the State, the Commonwealth Minister will take into account for each project: consistency with the project eligibility criteria in this Appendix and the outputs of this Agreement; the transparency and equity of the process used to select projects; the ‘value for money’ of the projects, having particular regard to the cost of each proposed project compared to the water estimated to be saved for the environment and the degree of protection to high value natural springs afforded by such a project; and the amount of funding available each financial year for the proposed project(s) and/or activities. Should the Commonwealth agree to the proposed project, HomeBuilder payments will be made on a matched basis subject to eligible applicants at the State achieving milestones specified following times: for new builds (including off-the-plan dwellings): the grant will be paid to align with the timing of grant payments as currently applies for existing First Home Owner Grant schemes in jurisdictions, or at the bilateral schedules to this Agreement. States will provide evidence in each annual performance report as to how discretion of the requirements of clauses A5 and A9 have been given effect. Project eligibility criteria Projects and activities that are eligible for funding under the program include: rehabilitation or replacement of ageing, legally-operated bores which are in an uncontrolled state with controlled bores and efficient watering system infrastructure particularly where such works will achieve significant and quantifiable environmental benefit or avoid significant and quantifiable environmental degradation; rehabilitation or replacement of bores jurisdiction where there is no First Home Owner Grant scheme in place; or for substantial renovations: once at least $150,000 of the contract price has been a critical failure of infrastructure assets previously rehabilitated under earlier programs jointly funded by the Parties, due to the impact of highly corrosive water or a generic failure of technology not due to poor workmanship or for the payment of normal maintenance costs; decommissioning of old bores where the state governments have implemented new regulatory responses that require landholders to manage their own assets; project management costs, audits of works, marketing and promotional material for the program; and compliance programs that assist state agencies to implement new Great Artesian Basin water management arrangements; activities to encourage landholders to adopt best practice approaches to maintaining water extraction and distribution infrastructure including education and communication activities which assist in minimising the wastage of water and increase water pressure; and undertaking studies that assist with the development and implementation of new water management arrangements within the Great Artesian Basin. All projects under clauses A8(a), (b) and (c) must have a water meter or pressure monitoring device. Any new water meter that is installed must be pattern approved (by the meter manufacturer or supplier) in accordance with requirements of the National Measurement Institute and installed and operated in accordance with ATS 4747 of Standards Australia. At least 70 per cent of the estimated water savings from an infrastructure project under clauses A8(a), (b) and (c) will be directed to restoring pressure to the formation in which it is saved in the Basin and must not be reallocated by the States for consumptive purposes. All projects under clauses A8(a), (b) and (c) require third party financial contributions. States may determine the quantum of third party contributions required for eligibility under this clausepaid.

Delegations. The relevant Commonwealth Minister with responsibility for the HomeBuilder program is authorised to agree and amend Schedules to this Agreement and to certify that performance benchmarks specified under this Agreement have been achieved, so that payments may be made. All projects under clauses A8(a), (b) and (c) must have a water meter or pressure monitoring device. Any new water meter that is installed must be pattern approved (by the meter manufacturer or supplier) in accordance with requirements of the National Measurement Institute and installed and operated in accordance with ATS 4747 of Standards Australia. At least 70 per cent of the estimated water savings from an infrastructure project under clauses A8(a), (b) and (c) will be directed to restoring pressure to the formation in which it is saved in the Basin and must not be reallocated by the States for consumptive purposes. The Commonwealth agrees to assess the proposed projects and/or activities project lists on a State-by-State basis for inclusion as part of bilateral schedules to this Agreement in accordance with the Assessment Guidelines set out in this AppendixSchedule. To access HomeBuilder, owner-occupier applicants must: be a natural person (not a company or trust); be aged 18 years or older on the contract date; be an Australian citizen; be below one of the following two income caps: $125,000 per annum for an individual applicant based on their 2018-19 taxable income or later; or $200,000 per annum for a couple based on their combined 2018-19 taxable income or later. be within one of the following price caps: for contracts entered into on or after 4 June 2020 up to and including 31 December 2020 to either: build a new home as a principal place of residence, where the property value (i.e. house and land) does not exceed $750,000; or substantially renovate an existing home as a principal place of residence, where the renovation contract is greater than $150,000 and does not exceed $750,000, and where the value of the existing property (i.e. house and land, before renovation) does not exceed $1.5 million; or for contracts entered into on or after 1 January 2021 up to and including 31 March 2021 to either: build a new home as a principal place of residence, where the property value (i.e. house and land) does not exceed: $950,000 if the dwelling is in New South Wales; $850,000 if the dwelling is in Victoria; or $750,000 in all other States; substantially renovate an existing home as a principal place of residence, where the renovation contract is greater than $150,000 and does not exceed $750,000, and where the value of the existing property (i.e. house and land, before renovation) does not exceed $1.5 million. In negotiating the contract, the parties must deal with each other at arm’s length. The Commonwealth agrees to assess the proposed projects and/or activities on a State-by-State basis proposal for inclusion as part of bilateral schedules to in this Agreement as a Commonwealth-funded project in accordance with the Assessment Guidelines set out in this Appendixthese Guidelines. The State Minister will provide to Commonwealth funding of an irrigation scheme is conditional on the Commonwealth Minister a list of proposed project(s) and/or activities for the term of this Agreement which may contain the following details: the estimated costings and completion date for each activity under each project or activity; the proposed funding required to achieve each project or activity (including details of proposed Commonwealth, State, third party and other contributions, where relevant); relevant outcomes for each project or activity; a description of the selection process for each project and/or rationale to support the activity; a description of the methods adopted to design and implement and, where necessary, justification for the particular approach taken; and how the proposed works contribute to one or more of the outputs at Part 2 – Project Outputs. States may include cash and contributions undertaking due diligence in estimating the cost of each proposed project. Only direct costs associated accordance with the Improving Great Artesian Basin Drought Resilience program are acceptable as such contributions. Administration items incurred and salaries and wages for officers spending less than 20 per cent of their time on the program, should not be included. In considering whether to agree to the list of proposed projects or activities submitted by the State, the Commonwealth Minister will take into account for each project: consistency with the project eligibility criteria in this Appendix and the outputs of this Agreement; the transparency and equity of the process used to select projects; the ‘value for money’ of the projects, having particular regard to the cost of each proposed project compared to the water estimated to be saved for the environment and the degree of protection to high value natural springs afforded by such a project; and the amount of funding available each financial year for the proposed project(s) and/or activitiesthese Guidelines. Should the Commonwealth agree to the proposed projectcontribute funds to an irrigation scheme, then payments will be made subject to progressing implementation of National Water Initiative Reform Actions by Tasmania (where applicable). To commence the due diligence process, the Commonwealth will require Tasmania to submit a proposal for each irrigation scheme. The Commonwealth may engage an independent third party to undertake some or all of the due diligence. Due Diligence Criteria The proposal for each irrigation scheme must provide sufficient information to enable the Commonwealth to commence due diligence. The criteria by which this assessment will be undertaken are: economic and social; environmental; value for money; water reform; and other. Economic and social criteria The proposal must: be able to secure a long-term sustainable future for irrigation communities, in the context of meeting future demand for water in a drying climate; contribute to regional investment and development, secure regional economies and support the local community; and demonstrate long-term economic and environmental benefit that can be sustained over a 30 year horizon, preferably supported by a modern, efficient irrigation plan. Environmental criteria Environmental impact assessments (short and long term) consistent with relevant State and Commonwealth legislation must form part of the business case for the proposal. Any proposal that involves investment in new or refurbished water infrastructure will be required to be assessed as ecologically sustainable prior to the investment occurring, consistent with Clause 69 of the Intergovernmental Agreement on a matched basis subject National Water Initiative. Value for money criteria The proposal must demonstrate value for money in the context of economic and social, and environmental criteria through: a positive cost-benefit outcome for a range of investment scenarios, compared with a ‘no change’ option; and clearly defined and agreed cost sharing arrangements. Water reform criteria All activities associated with the funding of a proposal must be in accordance with the Intergovernmental Agreement on a National Water Initiative. Tasmania must demonstrate how a proposal will be consistent with its defined National Water Initiative commitments within clearly specified timelines. Tasmania will ensure that proposals are National Water Initiative-compliant, or otherwise outline the steps in place to ensure National Water Initiative-compliance during the implementation of the proposal, particularly but not exclusive to the State achieving milestones specified areas of: water management planning and stakeholder engagement, including indigenous engagement; water access entitlements; water markets and trading; water pricing; metering; environmental water; and water data. Other criteria The proposal must be consistent with best practice, in particular: the bilateral schedules design for the proposal must include irrigation delivery systems that will run at a minimum 90% level of efficiency; and bulk water and farm off-takes are to this Agreementbe metered to new national metering standards with an in-field accuracy of +/- 5 per cent. States The proposal must integrate with Tasmania’s water planning documents and processes. The proposal must clearly demonstrate that the Commonwealth funding will provide evidence be used for on-ground works-related expenditure only and will not be used for financial restructuring or other purposes not directly related to on-ground works. The proposal must demonstrate suitable project management capability and capacity. The proposal’s irrigation scheme specifications must include: appropriate governance arrangements to ensure the irrigation scheme delivers on time, within budget and against all key objectives and outputs; compliance with other relevant jurisdictional legislation; indemnification of the Commonwealth against any environmental or other third party damage caused by the proposal; the Commonwealth to have no responsibility for any past, present or future taxation liabilities arising from investments; warranties on investments; and no allocation of responsibility to the Commonwealth for any legal contracts already entered into, except where explicitly agreed in each annual performance report as writing by the Commonwealth. The Commonwealth may take into account other relevant matters where necessary in undertaking its due diligence assessment. It is expected that Tasmania will, where required, commission suitably qualified, independent persons or organisations to how carry out detailed studies to inform the development of the proposal and demonstrate compliance with the requirements of clauses A5 and A9 have been given effectthis Schedule. All projects under clauses A8(a), (b) and (c) must have a water meter or pressure monitoring device. Any new water meter that is installed must be pattern approved (by the meter manufacturer or supplier) in accordance with requirements of the National Measurement Institute and installed and operated in accordance with ATS 4747 of Standards Australia. At least 70 per cent of the estimated water savings from an infrastructure project under clauses A8(a), (b) and (c) will be directed to restoring pressure to the formation in which it is saved in the Basin and must not be reallocated by the States for consumptive purposes.
