MANAGEMENT RIGHTS AND RESPONSIBILITIES. The Employer through its designated management personnel or agents has the right and responsibility, except as expressly modified by this Agreement, to control, change, and supervise all operations and to direct and assign work to all working forces. Such rights and responsibilities shall include by way of illustration but shall not be limited to: the selection and hiring, training, discipline and discharge, classification, reclassification, layoff, promotion and demotion or transfer of employees; the establishment of work schedules; the allocation of all financial and other resources; the control and regulation of the use of all equipment and other property of the Employer. The Employer shall determine the methods, technological means and qualifications of personnel by and for which operations are to be carried out. The Employer shall take whatever action as may be necessary to carry out its rights in any emergency situation. Application of this Article shall not preclude the use of the grievance procedure as established in this Agreement.
MANAGEMENT RIGHTS AND RESPONSIBILITIES. Section 2.1 Lodge recognizes the prerogative of Employer to operate and manage its affairs in all respects and in accordance with its responsibilities, and the powers of authority which Employer has not officially abridged, delegated, granted, or modified by this Agreement are retained by Employer, and all rights, powers, and authority Employer had prior to the signing of this Agreement are retained by Employer and remain exclusively without limitation within the rights of Employer.
Section 2.2 Except as may be limited herein, Employer retains the rights in accordance with the constitution and laws of the State of Oklahoma and the responsibilities and duties contained in the Charter of the City of Tulsa and the ordinances and regulations promulgated thereunder as follows:
(a) To determine Police Department policy including the rights to manage the affairs of the Police Department in all respects;
(b) To assign working hours, including overtime;
(c) To direct the members of the Police Department, including the right to hire, promote, or transfer any employee;
(d) To discipline, suspend or terminate any employee for good and sufficient cause (good and sufficient cause is synonymous with "just cause");
(e) To determine the organizational chart of the Police Department, including the right to organize and reorganize the Police Department and the determination of job classifications and ranks based upon duties assigned;
(f) To determine the safety, health, and property protection measures for the Police Department;
(g) To allocate and assign work to all Employees within the Police Department;
(h) To be the sole judge of the qualifications of applicants and training of new Employees;
(i) To schedule the operations and to determine the number and duration of hours of assigned duty per work period provided that any hours worked in excess of forty (40) hours per work period shall be considered overtime;
(j) To establish and enforce Police Department rules, regulations, and orders;
(k) To introduce new, improved, or different methods and techniques of Police Department operation or change existing methods and techniques;
(l) To determine the amount of supervision necessary;
(m) To control the departmental budget;
(n) To take whatever actions may be necessary to carry out the mission of Employer in situations of emergency.
MANAGEMENT RIGHTS AND RESPONSIBILITIES. Except as specifically limited to this Agreement, the Employer has the right and the responsibility to control, change, and supervise all operations, and to direct and assign employees. Such right and responsibility shall include, but not be limited to, the selection and hiring of employees, discipline for cause, classification, reclassification, suspension, layoff, promotion, demotion, or transfer of employees, establishment of work schedules, and control and regulations of the use of all equipment and other property of the University. The Employer is responsible for establishing and maintaining an appropriate standard of care for patients in this hospital. The Employer shall take whatever action as may be necessary to carry out its responsibilities in any emergency situations. Application of this Article shall not preclude use of the Grievance Procedure as established in this Agreement.
MANAGEMENT RIGHTS AND RESPONSIBILITIES. 4.1 The Employer, through its designated management personnel, has the right and responsibility, except as expressly modified by this Agreement, to control, change, and supervise all operations, and to direct and assign all employees work appropriate for their classification. Such right and responsibility shall include, by way of illustration but not limited to, the selection and hiring of employees, discipline (involuntary demotion, suspension, reduction in pay, and written reprimand) and discharge for just cause, classification, reclassification, layoff, promotion, demotion, reassignment or transfer, training of employees, establishment of work schedules in accordance with the contract, allocation of all financial and other resources, and control and regulation of the use of all equipment and other property of the University. The Employer shall determine the method, technological means, number and kind, and qualifications of personnel by and for which operations are to be carried out. The Employer shall take action as may be necessary to carry out its responsibilities in any emergency situation.
4.2 Except as otherwise provided in this Agreement and this Article, nothing contained herein is intended to nor shall be construed as a waiver of the Union’s right to compel bargaining prior to changes in any mandatory subject of bargaining.
4.3 It is understood and agreed that in order to maintain efficient operations, work may be transferred from the Police Officer unit or from the Chiefs into this unit, and from this unit either to the Police Officer unit or to the Chiefs. In the event that any proposed work transfer would result in an FTE reduction, the University would be required to bargain with the Union prior to such transfer.

Such rights and responsibilities shall include, but not be limited to, the selection and hiring of employees, discipline for cause, classification, reclassification, suspension, layoff, promotion, demotion or transfer of employees in accordance with the applicable Washington Personnel Resources Board Rules, establishment of work schedules; and control and regulation of the use of all equipment and other property of the University. The Employer is responsible for establishing and maintaining an appropriate standard of nursing care for patients in this Medical Center. The Employer shall take whatever action as may be necessary to carry out its rights in any emergency situation. Application of this Article shall not preclude use of the grievance procedure as established in this Agreement.
MANAGEMENT RIGHTS AND RESPONSIBILITIES. 1.3.1 The conduct of the Institute's business and educational affairs is ultimately the responsibility of the Board of Governors.
1.3.2 The management and direction of Employees in the Bargaining Unit is a right retained by the Employer, except as specified otherwise in this Agreement.
1.3.3 Except where otherwise specified in this Agreement, the Employer has the obligation and right to manage the business and educational affairs of the Institute. The Employer's obligations include, but are not limited to: the hiring and directing of the work force; the discipline or discharge for cause; assignment of duties as specified in Article 1.4; the organizational structure of the Institute; and the making, publication and enforcement of rules for the safety and protection of its Employees and equipment.
MANAGEMENT RIGHTS AND RESPONSIBILITIES. Except as abridged by this Agreement, the University retains and reserves to itself all rights, powers, duties, authority, and responsibilities conferred on and vested in it by the laws of the State of Oregon and the policies and procedures of the Board of Trustees of Southern Oregon University. Management has the sole and exclusive right to: administer the University; institute procedural changes which are consistent with this Agreement; direct the faculty and staff, including the right to hire, promote, demote, transfer, suspend, discipline or discharge any employee; and determine the physical location of programs, division/centers, and activities. With these rights, management accepts the responsibility to ensure that procedures and policies impacting a tangible employment action shall be carried out in a timely manner. Other rights include but are not limited to the right to determine financial policy, including accounting procedures and reports; determine the administrative organization of the University including determining the necessary number of administrative and supervisory personnel and prescribing their duties and responsibilities; determine the control and use of University buildings, property, materials, and equipment; and determine health, safety, and property protective measures and procedures; and determine ancillary services to be rendered by the University. Additional examples of management rights include but are not limited to the right to obtain detailed supporting documentation from those making recommendations to Directors, Xxxxxxx, and the President for appointments, promotions, and awards of indefinite tenure. Management has the right to the following, but agrees to consult with faculty when: scheduling class hours and establishing or modifying class schedules; determining the size and characteristics of the faculty; determining the allocation and assignment of work to faculty members, including off-campus assignments which are not inconsistent with this Agreement; developing and implementing a system of faculty evaluations including specific provisions for student participation; determining degree programs, course offerings, and degree requirements.
MANAGEMENT RIGHTS AND RESPONSIBILITIES. Union recognizes the prerogative of Employer to operate and manage its affairs in all respects and in accordance with its responsibilities; and the powers or authority which Employer has not officially abridged, delegated, granted or modified by this Agreement are retained by Employer; and all rights, powers, and authority Employer had prior to the signing of this Agreement are retained by Employer and remain exclusively without limitation within the rights of Employer. Except as may be limited herein, Employer retains the rights in accordance with the laws of the State of Oklahoma and the responsibilities and duties contained in the Charter of the City of Tulsa and the ordinances and regulations promulgated thereunder:
A. The determination of Fire Department policy including the right to manage the affairs of the Fire Department in all respects;
B. The right to assign working hours, including overtime;
C. The right to establish, modify, or change work schedules, xxxxxxx of apparatus, amount of apparatus in the fleet, etc.;
D. The right to direct the members of the Fire Department, including the right to hire, promote, or transfer any Employee;
E. The table of organization of the Fire Department, including the right to organize and reorganize the Fire Department in any manner it chooses, including the size
F. The determination of the safety, health, and property protection measures for the Fire Department;
G. The allocation and assignment of work to Employees within the Fire Department;
H. The sole judge of the qualifications of applicants and training of new employees;
I. The scheduling of operations and the determination of the number and duration of hours of assigned duty per week;
J. The establishment and enforcement of Fire Department rules, regulations, and orders;
K. The introduction of new, improved, or different methods and techniques of operation of the Fire Department or a change in existing methods and techniques;
L. The determination of the amount of supervision necessary;
M. The control of the departmental budget;
N. The right and responsibility to take whatever actions may be necessary to carry out the mission of the City in situations of emergency.
MANAGEMENT RIGHTS AND RESPONSIBILITIES. Subject only to the express terms of the Agreement the Union recognizes the right of the Employer to operate and manage his business in accordance with his commitments and responsibilities.
MANAGEMENT RIGHTS AND RESPONSIBILITIES. Except to the extent expressly modified or provided by a specific provision of this Agreement, the City reserves and retains solely and exclusively all of its statutory and common law rights to manage the operation of the Communications Center of the City of Xenia, Ohio. The sole and exclusive rights of the City which are not abridged by this Agreement shall include but are not limited to its right to establish or continue policies, practices or procedures for the conduct of the Communications Center and its services to the citizens of Xenia, and from time to time, to change or abolish such practices or procedures if the change or abolishment is not in conflict with this Agreement. The City retains the right:
A. to determine the number of hours per day or week any operation of the Communications Center may be carried on;
B. to recruit, select, and determine the number of qualifications and characteristics of employees;
C. to assign such work in accordance with the requirements determined by the City; to establish training programs and requirements for upgrading employees; to establish and change work schedules and assignments;
D. to transfer, promote, lay off, or otherwise relieve employees from duty for lack of work or other legitimate reasons; to continue, alter, make and enforce reasonable rules for the maintenance of discipline; to suspend, demote, discharge, or otherwise discipline employees for just cause;
E. the right to determine and from time to time re-determine, the number, locations, and relocation and types of its operators and employees or to discontinue any performance by operators or employees of the City of Xenia, and;
F. to take such measures as the City may determine to be necessary for the orderly and efficient operation of the Communications Center. Nothing herein shall prevent an employee from presenting a grievance for the alleged violation of any article or specific term of this Agreement.
