Common use of Delivery Charge Clause in Contracts

Delivery Charge. (a) For each Day in a Month, the Delivery Charge (in pounds sterling) shall be payable in respect of the Actual Utilisation Quantity delivered to the Customer, during that Day, pursuant to a Nomination or Nominations, and shall be calculated for the Day using the Indexed Delivery Charge . (b) Where there is a Transaction Shortfall Quantity (including if either Party fails to make a Trade Nomination), the Delivery Charge payable in accordance with Clause 10.4(a) shall be reduced by the amount of the Transaction Shortfall Quantity multiplied by: (i) SMBP, where such failure is caused by the Service Provider; or (ii) SMSP, where such failure is caused by the Customer.
