Delivery Discrepancies. Any discrepancies from the condition of the Aircraft as described in Schedule 3 which were identified by Lessee pursuant to Section 2.2.1 on or prior to the Delivery Date, and which were not corrected by Lessor or Airframe Manufacturer on or prior to the Delivery Date, shall be corrected by Lessee or its designee and Lessor shall reimburse Lessee at 100% of Lessee's reasonable actual cost for such correction, payable on demand. Such claim for reimbursement shall be Lessee's sole remedy for noncompliance, and Lessee shall not have the right to refuse acceptance of the Aircraft because of such discrepancies.

Delivery Discrepancies. 4.7.1. In the event that the customer experiences a delivery discrepancy with a delivered consignment this should be communicated to the contractor within five working days by telephone or email identifying the original purchase order number and business location as reference. The contractor shall investigate the matter and re-supply the product if this item has not been delivered to the customer. 4.7.2. The Authority will require a legible proof of delivery to ascertain a delivery has been made in the event of a dispute. 4.7.3. The contractor shall be liable for the cost of collection and re-delivery for discrepancies.
Delivery Discrepancies. In case of a shortfall of Product in a delivery (or vial) received from Supplier, Abcam shall notify Supplier of the discrepancy, detailing the lot number and volume found missing at the advised concentration. Supplier shall acknowledge Abcam’s notification within two (2) business days, and the Parties shall use their best efforts to promptly discuss and resolve the discrepancy in good faith. In the case of a discussion regarding whether an item has been shipped or delivered, where requested, Supplier shall provide appropriate proof of delivery, e.g., a signed tracking number referring specifically to the discussed item on a packing list or delivery note.
Delivery Discrepancies. All deliveries and all shipping and other charges shall be deemed correct unless Seller receives from Buyer, no later than thirty (30) days after Buyer’s receipt of a given shipment of Products, a written notice specifying the shipment and the exact nature of the discrepancy between the Purchase Order quantity to be delivered on that date and the quantity delivered or the exact nature of the discrepancy in the shipping or other charges, as applicable. Any Products supplied by Seller under this Agreement that fail to conform to the Specifications shall be subject to the provisions of Section 4.11 below.

  • PRODUCT DELIVERY Delivery must be made as ordered to the address specified on the Purchase Order and in accordance with the terms of the Contract or Contract Award Notice. Failure to meet such delivery time schedule may be grounds for cancellation of the order or, in the Commissioner’s discretion, the Contract.

  • Delivery Location All Goods shall be delivered to the address specified in this Order (the "Delivery Location") during Buyer's normal business hours or as otherwise instructed by Buyer.

  • Purchase Order A Customer may use purchase orders to buy commodities or contractual services pursuant to the Contract and, if applicable, the Contractor must provide commodities or contractual services pursuant to purchase orders. Purchase orders issued pursuant to the Contract must be received by the Contractor no later than the close of business on the last day of the Contract’s term. The Contractor is required to accept timely purchase orders specifying delivery schedules that extend beyond the Contract term even when such extended delivery will occur after expiration of the Contract. Purchase orders shall be valid through their specified term and performance by the Contractor, and all terms and conditions of the Contract shall survive the termination or expiration of the Contract and apply to the Contractor’s performance. The duration of purchase orders for recurring deliverables shall not exceed the expiration of the Contract by more than twelve months. Any purchase order terms and conditions conflicting with these Special Contract Conditions shall not become a part of the Contract.

  • DELIVERY SCHEDULES In accordance with the "Non-State Agencies Participation in Centralized Contracts” and “Extension of Use” clauses herein, this Contract is extended to local governments, political subdivisions and others authorized by law as well as State agencies. The Delivery Schedules (based on Requirement Letter RL182) are available as a guide to indicate proposed delivery points and estimated annual requirements. Delivery Schedules may be revised or clarified as necessary. Any specific questions regarding the site conditions should be directed to the end-user at the telephone number shown on the Delivery Schedule. The Delivery Schedules are available upon request. Contractors shall be obligated to deliver under the Contract to any State agency which places a purchase order under the Contract, whether or not such delivery location is identified in the Delivery Schedules. Any political subdivision or other non-State entity which has not filed a requirement with OGS as of the date of the bid opening shall be eligible to receive deliveries at Contractor's option only, upon placement of a valid purchase order to the Contractor's address as indicated in the award. Contracts created by OGS in response to receipt of Filed Requirements are considered to be binding. At Contractor's request, Contractor will be advised in writing regarding political subdivisions or other Non-State entities which have filed on a timely basis but do not appear on the Delivery Schedule. Where “Standby” is indicated in the Delivery Schedule, this reflects those facilities which normally use a fuel supply (i.e. natural gas) other than fuel oil and will only use fuel oil when alternate fuel is unavailable.

  • Delivery Delay The delivery of any certificate representing the Restricted Stock or other RS Property may be postponed by the Company for such period as may be required for it to comply with any applicable foreign, federal, state or provincial securities law, or any national securities exchange listing requirements and the Company is not obligated to issue or deliver any securities if, in the opinion of counsel for the Company, the issuance of such Shares shall constitute a violation by the Participant or the Company of any provisions of any applicable foreign, federal, state or provincial law or of any regulations of any governmental authority or any national securities exchange.
