Common use of Description of Appropriate Unit Clause in Contracts

Description of Appropriate Unit. For purposes of the Agreement, the term “appropriate unit” shall mean all persons in the appropriate unit employed by the School District in such classification excluding the following: confidential employees, supervisory employees, essential employees, part- time employees whose services do not exceed the lessor of thirty five percent (35%) of the normal work week in the employees bargaining unit or 14 hours per week, employees who hold positions of a temporary or seasonal character for a period not in excess of sixty-seven (67) working days in a calendar year unless those positions have already been filled in the same calendar year and the cumulative number of days in the same position by all employees exceeds sixty-seven (67) calendar days in that year, and emergency employees.

For purposes of the this Agreement, the term “appropriate unit” maintenance, food service, teacher associates, and clerical/secretarial employees shall mean all persons in the appropriate unit employed by the School District school district in such classification classifications excluding the following: confidential employees, supervisory employees, essential employees, part- part-time employees whose services do not exceed the lessor lesser of thirty five 14 hours per week or 35 percent (35%) of the normal work week in the employees bargaining unit or 14 hours per weekunit, employees who hold positions of a temporary or seasonal character for a period not in excess of sixty-seven (67) 67 working days in a any calendar year unless those positions have already been filled in the same calendar year and the cumulative number of days in the same position by all employees exceeds sixty-seven (67) 67 calendar days in that year, year and emergency employees.

A calendar year shall be defined as January 1 thru December 31.
