Common use of Design, Construction, Operation, Maintenance and Rehabilitation Clause in Contracts

Design, Construction, Operation, Maintenance and Rehabilitation. Subject to and in accordance with the provisions of this Agreement the Concessionaire will: 3.1.1 design, construct, complete, commission and test the Works; 3.1.2 operate, maintain and rehabilitate the Project Facilities, the Site and the Adjacent Areas following Substantial Completion; 3.1.3 perform the Decommissioning; 3.1.4 conduct the other Undertakings during the Contract Period; and 3.1.5 finance the activities referred to in Sections 3.1.1 to 3.1.4, at its own cost and risk without recourse to public funds (other than as expressly provided in this Agreement) or Province guarantees.
