Design Provisions. Minimum Channel Capacity. The Grantee shall provide a System utilizing equipment which is capable of delivering at least eighty (80) channels of programming. All programming decisions remain the sole discretion of the Grantee. Grantee shall notify the City and Subscribers in writing prior to any channel additions, deletions, or realignments. Written notice should be provided at least thirty (30) days prior to any channel additions, deletions, or realignments.

Design Provisions. (a) If the Project involves Construction, the following provisions apply:

All programming decisions remain the sole discretion of Grantee provided that Grantee complies with federal law regarding notice to City and subscribers prior to any channel additions, deletions, or realignments, and further subject to Grantee's signal carriage obligations pursuant to 47 U.S.C. §§ 531-536, and subject to City's rights pursuant to 47 U.S.C. § 545. Grantee shall conduct programming surveys from time to time to obtain input on programming decisions from subscribers.
