DESIGN SERVICES WHEN AUTHORIZED IN WRITING. a. Schematic Design Phase Pursuant to conferences with the State, designs shall be prepared by the Consultant to encompass the general program of the project. These designs shall consist of small scale drawings, elevations, sections and outline specifications. All specifications shall be prepared in accordance with the Construction Specifications Institute (CSI) format. At this time the Consultant shall make sufficiently accurate estimates to determine the feasibility of constructing the project within the funds available. At the beginning of the schematic design phase, the Consultant shall engage its consultants as set forth in Section J below. The Consultant shall submit for review and approval the number of sets of drawings, specifications and detailed cost estimates as indicated in the specific task letter. While preparing such drawings, specifications and detailed cost estimates, the Consultant shall investigate any factors that may conflict with completing the project as proposed, and shall report its findings thereon to the State when submitting schematic design phase drawings, outline specifications and detailed cost estimates. If the estimate agreed to by the State and Consultant exceeds the total construction budget noted in the task letter, or if the State and Consultant cannot agree upon an estimate of the probable construction cost and the probable cost of construction as determined by the State exceeds both the Consultant's estimate and the total construction budget noted in the task letter, then the Consultant shall make appropriate recommendations to the State for adjustments to the documents in regards to the project’s scope, quality, or budget. At that time, the State shall have the right to require the Consultant to modify the documents as the State deems necessary to bring the cost within the amount of the total construction budget noted in the task letter. The revisions shall be made without additional compensation to the Consultant.
