Designation and Change of Beneficiary. Each Participant may file with the Committee a written designation of one or more Persons as the beneficiary or beneficiaries, as applicable, who shall be entitled to receive the amounts payable with respect to an Award, if any, due under the Plan upon the Participant’s death. A Participant may, from time to time, revoke or change the Participant’s beneficiary designation without the consent of any prior beneficiary by filing a new designation with the Committee. The last such designation received by the Committee shall be controlling; provided, however, that no designation, or change or revocation thereof, shall be effective unless received by the Committee prior to the Participant’s death, and in no event shall it be effective as of a date prior to such receipt. If no beneficiary designation is filed by a Participant, the beneficiary shall be deemed to be the Participant’s spouse or, if the Participant is unmarried at the time of death, the Participant’s estate.

Each Holder shall file with the Committee a written designation of one or more persons as the Beneficiary who shall be entitled to receive the amount, if any, payable under this Warrant upon his or her death. A Holder may, from time to time, revoke or change his or her Beneficiary designation without the consent of any prior Beneficiary by filing a new designation with the Committee. The last such designation received by the Committee shall be controlling; provided, however, that no designation, or change or revocation thereof, shall be effective unless received by the Committee prior to the Holder's death, and in no event shall it be effective as of a date prior to such receipt.

Grantee may file with the Committee a written designation of one or more persons as the beneficiary who shall be entitled to receive the rights or amounts payable with respect to the Options upon Grantee's death. Grantee may, from time to time, revoke or change Grantee's beneficiary designation without the consent of any prior beneficiary by filing a new designation with the Committee. The last such designation received by the Committee shall be controlling; provided, however, that no designation, or change or revocation thereof, shall be effective unless received by the Committee prior to Grantee's death, and in no event shall it be effective as of a date prior to such receipt. If no beneficiary designation is filed by Grantee, the beneficiary shall be deemed to be Grantee's spouse, if Grantee is unmarried at the time of death, Grantee's estate.
Designation and Change of Beneficiary. A Participant may designate a beneficiary to receive any payment of a death benefit due upon the death of such Participant and may subsequently change the beneficiary designation. Such designation or change will take effect upon receipt by TFLIC of written notice of the designation or change. If a Participant elects joint coverage on the Lock-In Date pursuant to Section 5.9, the Participant’s spouse must be named as the Beneficiary of the Account as of the Lock-In Date.

Subject to the rights of an irrevocable Beneficiary, the designation of Beneficiary may be changed or revoked. Any change or revocation must be filed with the Company at its Annuity Service Mailing Address in such form as the Company may require. When the Company receives the change or revocation, it will be effective as of the date on which the Beneficiary designation or revocation was signed, but the change or revocation will be without prejudice to the Company on account of any payment made or any action taken by the Company before the Company receives and acknowledges the change or revocation.

Any deficiency in payments already made by the Company shall be paid promptly and any excess in the payments already made by the Company shall be charged against the benefits falling due after the adjustment. This Certificate is issued in consideration of the Application, if any, and payment of the initial Purchase Payment. All statements made in any Application will be deemed representations and not warranties, and no statement will void the Certificate or be used in defense to a claim unless it is contained in such Application, if any, or in a similar document, and a copy is attached to the Certificate at issue. Only the President, a Vice President, the Actuary or the Secretary of the Company has authority to agree on the Company's behalf to any alteration of the Contract or any Certificate, or to any waiver of the rights or requirements of the Company.

If at the date of a Participant's death, there is no designation of a Beneficiary in effect for the Participant pursuant so the provisions of this Section 11, or if no Beneficiary designated by the Participant in accordance with the provisions hereof survives to receive any amount, or any Common Shares, payable under the Plan by reason of the Participant's death, the Participant's estate shall be treated as the Participant's Beneficiary for purposes of the Plan.

Participant shall indicate in writing upon execution of his Employment Agreement a designation of one or more persons as the Beneficiary who shall be entitled to receive the amount, if any, payable under the Plan upon the death of Participant. Participant may, from time to time, revoke or change his Beneficiary designation without the consent of any prior Beneficiary by filing a written designation with the Board of Directors of the Company. The last such designation received by the Board of Directors of the Company shall be controlling; provided, however, that no designation, or change or revocation thereof, shall be effective unless received by the Board of Directors of the Company prior to Participant's death, and in no event shall it be effective as of a date prior to such receipt.
Designation and Change of Beneficiary. (a) Executive shall file with the Company a written designation of one or more persons as the beneficiary (the "Beneficiary") who shall be entitled to receive the death benefit payable upon his or her death under Section 1 or 2 hereof. Executive may, from time to time, revoke or change his or her Beneficiary designation without the consent of any Beneficiary named therein by filing a new designation with the Company. The last such designation received by the Company shall be controlling, provided that no designation, or change or revocation thereof, shall be effective unless received by the Company prior to Executive's death, and in no event shall it be effective as of a date prior to such receipt.
(b) If no such Beneficiary designation is in effect at the time of Executive's death, or if no designated Beneficiary survives Executive, or if such designation conflicts with law, Executive's estate shall be deemed to have been designated his or her Beneficiary, and the executor or administrator thereof shall receive the death benefit payable under this Agreement following Executive's death. If the Company is in doubt as to the right of any person to receive all or part of the death benefit, the Company may retain such amount until the rights thereto are determined, or the Company may pay such amount into any court of appropriate jurisdiction and such payment shall be a complete discharge of the liability of the Company therefor.

You may revoke or change your beneficiary designation without the consent of any prior beneficiary by filing a new beneficiary designation with the Committee. The last such designation received by the Committee will be controlling; provided, that no designation, or change or revocation thereof, will be effective unless received by the Committee prior to your death, and in no event will it be effective as of a date prior to such receipt. If no beneficiary designation is filed by you, the beneficiary will be deemed to be your spouse or, if you are unmarried at the time of your death, your estate.
