Determination in Current Position. (a) If an employee is found to be unfit for their current position based on a new criminal records check and the Agency proceeds under Article 20, the employee retains all Article 20 rights. (b) If a regular status employee is determined to be unfit for their current position based on a new requirement, then the employee shall be notified of the determination and upon request will be informed of the information from the criminal record used in the determination. The employee will be provided options, including layoff.
