Common use of Developer’s Notice of Delay Clause in Contracts

Developer’s Notice of Delay. and request for a time extension pursuant to subparagraph 16.2 is a condition precedent to Developer’s submittal of and/or entitlement to a claim pursuant to Article 25 of these Construction Provisions. Developer shall notify the District pursuant to the claims provisions in these Construction Provisions of any anticipated delay and its cause. Following submission of a claim, the District may determine whether the delay is to be considered avoidable or unavoidable, how long it continues, and to what extent the prosecution and completion of the Work might be delayed thereby.
