Developer’s Supervision. 6.3.1 During progress of the Work, Developer shall keep on the Premises, and at all other locations where any Work related to the Contract is being performed, an experienced and competent project manager and construction superintendent who are employees of the Developer, to whom the District does not object and at least one of whom shall be fluent in English, written and verbal. 6.3.2 The project manager and construction superintendent shall both speak fluently the predominant language of the Developer’s employees. 6.3.3 Before commencing the Work herein, Developer shall give written notice to District of the name of its project manager and construction superintendent. If the Developer’s project manager and/or construction superintendent proves to be unsatisfactory to Developer, or to District, any of the District's employees, agents, the Construction Manager, or the Architect, Developer shall immediately notify District in writing before any change occurs, but no less than two (2) business days prior. Any replacement of the project manager and/or construction superintendent shall be made promptly and must be satisfactory to the District. The Developer’s project manager and construction superintendent shall each represent Developer, and all directions given to Developer’s project manager and/or construction superintendent shall be as binding as if given to Developer. 6.3.4 Developer shall give efficient supervision to Work, using its best skill and attention. 6.2.5. The Developer shall have verify all indicated dimensions before ordering materials or equipment, or before performing work. The Developer shall take field measurements, verify field conditions, and shall carefully compare such field measurements and conditions and other information known to the Developer with the Project Documents before commencing work. Errors, inconsistencies or omissions discovered shall be reported to the District at once. Upon commencement of any item of work, the Developer shall be responsible for dimensions related to such item of work and shall make any corrections necessary to make work properly fit at no additional cost to District. This responsibility for discovery verification of errorsdimensions is a non-delegable duty and may not be delegated to subcontractors or agents.
6.2.6. Omissions from the plans, inconsistenciesdrawings or specifications, or omissionsthe misdescription of details of work which are manifestly necessary to carry out the intent of the plans, drawings and specifications, or which are customarily performed, shall not relieve the Developer from performing such omitted or misdescribed work, but they shall be performed as if fully and correctly set forth and described in the plans, drawings and specifications.
6.3.5 All contractors doing 6.2.7. The Developer shall be solely responsible for the means, methods, techniques, sequences, and procedures of construction. The Developer shall be responsible to see that the finished work on complies accurately with the Project will provide their workers with identification badges.
