Distracting Program. In the event that RBNC or its Affiliate or its Sublicensee gains rights to a Distracting Program, then RBNC shall provide prompt written notice (in all events within [***] days of gaining such rights) to AMGEN and include in such notice whether RBNC elects to treat all Distracting Product(s) that are the subject of such Distracting Program as “Product(s)” under this Agreement.
