Common use of Distribution Upgrades Clause in Contracts

Distribution Upgrades. The Utility shall design, procure, construct, install, and own the Distribution Upgrades described in Appendix 6 of this Agreement. The actual cost of the Distribution Upgrades, including overheads, on-going operations, maintenance, repair, and replacement, shall be directly assigned to the Interconnection Customer.

Distribution Upgrades. The Utility Transmission Provider or Transmission Provider shall design, procure, construct, install, and own the Distribution distribution Upgrades described in Appendix 6 5 of this Agreementagreement. The actual cost of the Distribution Upgrades, including overheads, on-going operations, maintenance, repair, and replacement, shall be directly assigned to the Interconnection Customer.

If the Utility and the Interconnection Customer agree, the Interconnection Customer may construct Distribution Upgrades that are located on land owned by the Interconnection Customer. The actual cost of the Distribution Upgrades, including overheads, on-on- going operations, maintenance, repair, and replacement, shall be directly assigned to the Interconnection Customer.
