Common use of Diversion Monitoring Clause in Contracts

Diversion Monitoring. Permittee shall install and maintain an adequate measuring device for measuring the instantaneous and cumulative rate of diversion. The device shall be installed within the flow of diverted water. Permittee shall maintain records of diversion with: 1. The date and time diversion occurred, and 2. The amount of water used per day for cannabis cultivation separated out from the amount of water used for other irrigation purposes and other uses of water (e.g., domestic use or fire protection). 3. Permittee shall make available for review at the request of the department the daily diversion records required by the State Water Resources Control Board (Board) in Attachment A to the Board’s Cannabis Cultivation Policy (October 17, 2017), No. 84, pages 40-41 (see Cal. Code Regs., tit. 23, § 2925).
