Common use of Divisibility Clause in Contracts

Divisibility. It is the intent of the parties that the provisions of this Section 5 be enforced to the fullest extent permitted by applicable law. Accordingly, the provisions contained in this Section 5 as to the time period, geographic area and scope of activities restricted shall be deemed divisible, so that if any provision contained in this Section 5 is determined to be invalid or unenforceable, that provision shall be deemed modified so as to be valid and enforceable to the fullest extent lawfully permitted.
