DURATION OF THE SPECIAL OFFER. 5.1. The Restaurateur may choose to publish a Special Offer for a fixed or indefinite term. The minimum duration of a Special Offer is thirty-two (32) consecutive days or, in the case of special events, such as the TheFork Festival, the minimum duration set for such an event as communicated to the Restaurateur by TheFork. If the Special Offer was published for an indefinite duration, each party may terminate the Special Offer in writing (including by email) at any time after the expiration of the applicable minimum duration subject to seven (7) days' prior notice. If the Special Offer was published for a fixed term, the Restaurateur is entitled to renew it multiple times unless a Special Offer is no more offered as an option by TheFork in accordance with the above Article 4 of the Conditions of the Special Offer(s).

CLAUSE 6 - MISCELLANEOUS The Restaurateur must also comply with the following conditions: ∙ No rate increases may be made before or during the term of the Special Offer. ∙ A Special Offer must be applied to a User who arrives at its Restaurant at the booked time and up to 15 minutes thereafter, provided that this User otherwise meets the Conditions of the Special Offer. If a group of Users made a reservation with a Special Offer, the Restaurateur agrees to apply the Special Offer to the Users in this group who meet the Conditions of the Special Offer, even if one or more Users in this group do not meet the Conditions of the Special Offer, strictly provided that the entire group of Users arrive at the Restaurant at the booked time or at most 15 minutes thereafter. If all of the Users in the group have not arrived more than 15 minutes after the booked time, the Restaurateur is entitled to refuse to apply the Special Offer to all Users in such group. ∙ If, when the User complies with the Conditions of the Special Offer the Special Offer is not applied for any reason whatsoever, the Restaurateur shall refund the User (or TheFork if it has refunded the User, in which case the Restaurateur shall be invoiced at the end of the month) the difference between the amount the User paid for the meal and the amount that the User would have had to pay for the meal under the Special Offer Conditions. ∙ The Restaurateur must comply with all the provisions of these Specific Conditions while the Special Offer is available on the Portal and the Partner Sites as well as when the offer is renewed. ∙ Unless otherwise agreed, the Restaurateur agrees that TheFork may publish the Special Offer on The Partner Sites.
