Early Construction Works. Subject to the Company establishing the Site Reinstatement Bond and otherwise complying with the terms of the Lease, nothing in this Agreement shall be construed as preventing the Company from commencing construction activity at its sole cost and expense prior to commencement of the Construction Period and such commencement of construction activity shall not in any way prejudice any right of CEB to terminate this Agreement in accordance with Clause 4.7 and CEB shall have no liability to the Company whatsoever for any costs or expenses incurred or losses suffered by the Company.
