Effect of Elective Termination. Elective termination of this Agreement by Attaching Party, as permitted under Section 4 of this Agreement, shall not affect Attaching Party’s liabilities and obligations incurred under this Agreement prior to the effective date of termination and shall not entitle Attaching Party to the refund of any advance payment made to SBC-13STATE under this Agreement. Elective termination of this Agreement by SBC-13STATE shall not affect SBC-13STATE’s obligations to afford access to SBC- 13STATE’s poles, ducts, conduits, and rights-of-way owned or controlled by SBC-13STATE as required by the Pole Attachment Act, the Telecommunications Act of 1996, and other applicable laws, regulations, and commission orders.
Effect of Elective Termination. Effect of Elective Termination. Either Party’s elective termination of this Agreement, as permitted under Section 26.6 of this Agreement, will not affect either Party’s liabilities and obligations incurred under this Agreement prior to the effective date of termination and will not entitle Attaching Party to the refund of any advance payment made to AT&T under this Agreement.
