Common use of Entitlement to Medicare or Medicaid Clause in Contracts

Entitlement to Medicare or Medicaid. If a Participant, Participant’s spouse or Participant’s Dependent who is enrolled in an accident or health plan of the Employer becomes entitled to Medicare or Medicaid (other than coverage consisting solely of benefits under Section 1928 of the Social Security Act providing for pediatric vaccines), the Participant may cancel or reduce health coverage under the Employer’s Plan. Loss of Medicare or Medicaid entitlement would allow the Participant to add health coverage under the Employer’s Plan.
