Environmental Incidents an Environmental Incident occurs which gives rise, or may give rise, to an Environmental Claim which could, in the opinion of the Agent be expected to have a material adverse effect (i) on the business, assets or financial condition of any Security Party or the Group taken as a whole or (ii) on the security constituted by any of the Security Documents or the enforceability of that security in accordance with its terms; or

7.5.2 In the event of an environmental incident, the Operator shall: carry out an investigation to identify the nature and cause of the incident and any emission arising; isolate the source of any such emission; evaluate the environmental pollution/ contamination, if any, caused by the incident; identify and execute measures to minimise the emissions and the effects thereof; notify relevant authorities; notify the Authority as soon as practicable.
7.5.3 The Operator shall identify and put in place measures to avoid the reoccurrence of the incident.
Environmental Incidents an Environmental Incident occurs which gives rise, or may give rise, to an Environmental Claim for an amount or amounts exceeding six hundred thousand Dollars ($600,000) which could, in the reasonable opinion of the Lender be expected to have a Material Adverse Effect (i) on the financial condition of any Security Party or (ii) on the security constituted by any of the Security Documents or the enforceability of that security in accordance with its terms; or

All environmental incidents such as pollution (air, water, land, noise, etc.), bird kills, and animals killed, plants destroyed, public complaints etc. shall be reported to project leader and / or environmental advisor within 24 hours of its occurrence. • All environmental incidents occurring on site shall be recorded according to Eskom Procedure detailing how each incident was dealt with. Proof thereof must be kept in an incident register. • The Contractor shall be held liable for any infringement of statutory requirements of the Environmental relevant legislation.
