Epidemic Defined. An epidemic failure shall occur when a) one half of one percent (.5%) or the threshold amount stated in the Specification, whichever is less, of the Product shall be non-conforming over a period of thirty (30) days or more or b) one percent (1%) of Maxtor's application delivered to one or more customers shall fail due to a failure of the TI device within six (6) months of delivery.
