Common use of Equipment and Services Warranty Clause in Contracts

Equipment and Services Warranty. Extrel warrants that Equipment (excluding Software, which is warranted as specified in paragraph (d) below) shall be delivered substantially free of defects in material and workmanship and that Services shall be substantially free of defects in workmanship. The Warranty Remedy Period for Equipment (excluding Software, spare parts, and refurbished or repaired parts) shall end twelve (12) months after installation or eighteen (18) months after date of shipment, whichever first occurs. The Warranty Remedy Period for new spare parts or refurbished or repaired parts shall end ninety (90) calendar days after date of shipment. The Warranty Remedy Period for Services shall end ninety (90) calendar days after the date of completion of Services.
