Common use of Equipment Changes Clause in Contracts

Equipment Changes. Lessee will not make any modification or addition to the Aircraft (each an "EQUIPMENT CHANGE"), except for an Equipment Change which: (i) is expressly permitted or required by the Lease; or (ii) has (x) a cost (including labor) of less than the Modification Approval Amount or (y) the prior written approval of Lessor, and (z) in either case, does not diminish the condition, utility, airworthiness or value of the Aircraft. So long as no Default has occurred and is continuing, Lessee may remove or reverse any Equipment Change provided that the Equipment Change is not required pursuant to the terms of the Lease or to maintain the Insurances and removal or reversal does not diminish the value, utility, airworthiness or condition of the Aircraft assuming that such Equipment Change was not made and that Aircraft is maintained in accordance with the Lease. Furthermore, Lessor may require Lessee to remove or reverse any Equipment Change on the Expiry Date and to restore the Aircraft to its condition prior to that Equipment Change. Any Equipment Change not so removed or reversed becomes the property of Lessor or Owner, as the case may be, at the Expiry Date.

Furthermore, Lessor may require Lessee to remove or reverse any Equipment Change prior to the Return Occasion so that, on the Expiry Date and to restore the Aircraft is restored to its the condition it was in prior to that Equipment Change.
