Common use of Equipment Declared BER/BR Clause in Contracts

Equipment Declared BER/BR. 9.1 Where the Contractor deems repair to be impracticable or uneconomical in accordance with the requirements of Para 2.1.5 no further work is to be undertaken. 9.2 By exception, in cases where obsolescence is an agreed issue recorded against the Article in this SOR the Contractor is to seek further guidance and approval from the Authority before proceeding. 9.3 Equipment declared BER/BR is to be disposed of at the ‘best interests of the Crown’, with any proceeds from sale credited to the Authority.
