Establish Mitigation. TNBC agrees that it will serve as the Plan Operator under the NBHCP, and will Acquire, locate, operate, manage, and maintain Mitigation Lands in accordance with Chapters IV through VI of the NBHCP and Section 5 of this Agreement. To the extent provided in the NBHCP, such activities shall be carried out in consultation with the TAC and with the approval of the Wildlife Agencies.
