Common use of Excavation Clause in Contracts

Excavation. If any excavation shall be made upon land adjacent to or under the Building, or shall be authorized to be made, Tenant shall afford to the person causing or authorized to cause such excavation, reasonable license to enter the Premises for the purpose of performing such work as said person shall deem necessary or desirable to preserve and protect the Building from injury or damage and to support the same by proper foundations, without any claim for damages or liability against Landlord and without reducing or otherwise affecting Tenant’s obligations under this Lease so long as Tenant’s use and enjoyment of the Premises is not materially interfered with.

Excavation. If any excavation shall be made upon land adjacent to or under the Building, or shall be authorized to be made, Tenant shall afford to the person causing or authorized to cause such excavation, reasonable excavation license to enter the Premises for the purpose of performing such work as said person shall deem reasonably necessary or desirable to preserve and protect the Building from injury or damage and to support the same by proper foundations, without any claim for damages or liability against Landlord (except in the case of Landlord Parties’ willful misconduct or gross negligence) and without reducing or otherwise affecting Tenant’s obligations under this Lease so long as Lease. Any such work must be conducted in a manner that minimizes disruption and inconvenience to Tenant’s use and enjoyment of the Premises is not materially interfered with.

If any an excavation shall be made upon land adjacent to or under the Buildingdemised premises, or shall be authorized to be made, Tenant shall afford to the person causing or authorized to cause such excavation, reasonable a license to enter upon the Premises demised premises for the purpose of performing doing such work as said person shall deem necessary or desirable to preserve and protect the Building wall or the building, of which demised premises form, a part, from injury or damage damage, and to support the same by proper foundations, without any claim for damages or liability indemnity against Landlord and without reducing Owner, or otherwise affecting Tenant’s obligations under this Lease so long as Tenant’s use and enjoyment diminution or abatement of the Premises is not materially interfered withrent.
