Common use of Excavation Clause in Contracts

Excavation. If an excavation shall be made upon land adjacent to the Leased Premises, or shall be authorized to be made, Tenant shall afford to the person causing or authorized to cause such excavation, license to enter upon the Leased Premises for the purpose of doing such work as said person shall deem necessary to preserve the wall or the building of which the Leased Premises form a part from injury or damage and to support the same by proper foundation, without any claim for damages or indemnity from Landlord, or diminution or abatement of Rent.

Excavation. If an any excavation shall be made upon land adjacent to or under the Leased PremisesBuilding, or shall be authorized to be made, Tenant shall afford to the person causing or authorized to cause such excavation, license to enter upon the Leased Premises for the purpose of doing performing such work as said person shall deem necessary or desirable to preserve and protect the wall or the building of which the Leased Premises form a part Building from injury or damage and to support the same by proper foundationfoundations, without any claim for damages or indemnity from Landlord, liability against Landlord and without reducing or diminution or abatement of Rentotherwise affecting Tenant’s obligations under this Lease.

If an any excavation shall be made upon land adjacent to or under the Leased PremisesBuilding, or shall be authorized to be made, Tenant shall afford to the person causing or authorized to cause such excavation, reasonable license to enter upon the Leased Premises for the purpose of doing performing such work as said person shall deem necessary or desirable to preserve and protect the wall or the building of which the Leased Premises form a part Building from injury or damage and to support the same by proper foundationfoundations, without any claim for damages or indemnity from Landlord, liability against Landlord and without reducing or diminution or abatement otherwise affecting Tenant’s obligations under this Lease so long as Tenant’s use and enjoyment of Rentthe Premises is not materially interfered with.

Any such work must be conducted in a manner that minimizes disruption and inconvenience to Tenant.

If In the event that an excavation shall should be made for building or other purposes upon land adjacent to the Leased PremisesDevelopment, or shall should be authorized to be made, the Tenant shall shall, if necessary, afford to the person or persons causing or authorized to cause such excavation, license to enter upon the Leased Demised Premises for the purpose of doing such work as said person shall deem reasonably be necessary to protect or preserve the wall or walls of the building of which Building, or the Leased Premises form a part Building from injury or damage and to support the same them by proper foundation, without any claim for damages or indemnity from Landlord, or diminution or abatement of Rentpinning and/or underpinning.
