Common use of Excavations Clause in Contracts

Excavations. The Contractor shall provide suitable and adequate shoring to the sides of excavations, where there is a danger of falls or dislodgement of the sides. In particular, the safety of pedestrians must be given priority and excavations must be boarded over, when work is not in progress. Barriers must be provided and illuminated where necessary, and the appropriate warning signs erected informing people of any danger. Excavations must be checked prior to entry at start of shift and a competent person must carry out a weekly inspection and the results recorded. Underground And General Services Before commencing on any excavation work, the Contractor must consult the Establishments Site Manager or his representative in order to find out the exact location of any underground services that may be present. The Contractor’s employees must be familiar with and have received information, instruction and training in the dangers of underground services, such as gas, electricity and water prior to commencing any work, and employees must be supervised. Detectors must be used to identify services. Power tools must not be used within 0.5 metres of the marked position and location of pipes, cables and ducts but the ground must be dug out by hand. Any damages made to services must be reported to the Establishments Site Manager or his representatives. Contractors must not connect or interfere with the water, gas, or electrical or other service without the permission of the Establishments Site Manager or his representative; connection of 110-volt portable electric tools is exempt from this rule. Mechanical Excavators, Mobile Cranes & Mobile Elevated Work Platforms Excavators, mobile cranes and mobile elevated work platforms must not be used on prison premises without the permission of the Establishments Site Manager and the Security Department and must be accompanied by a 12 monthly examination report, and valid test certificate. The machine must comply with the Provision and Use of Work Equipment Regulations. The safe working load must be clearly marked on the machine or a copy of the tables of safe working loads, bearing the identification number of the machine, must be clearly visible in the cab. The machine operator must be adequately trained and must hold a valid certificate of competence. Electricity The voltage of all portable electric power tools and lighting apparatus used on site must not exceed 110 volts. All such equipment must be XXX tested by the Contractor prior to being used on site and records kept and available for inspection. All equipment used must comply with Provision and Use of Work Equipment Regulations, and the Electricity at Work Regulations. Gas Cylinders and Bitumen Boilers Bitumen boilers must not be left unattended at any time whilst the burners are alight. The cylinders must be stored at least 3 metres from the appliance, and fed through armoured flexible hose. Gas cylinders not in use must be stored in a fireproof enclosure, away from buildings and marked highly flammable – LPG. A suitable and sufficient fire extinguisher must be made available and sited within close proximity to boilers etc and employees suitably trained in its use. Welding and Cutting Operations Before any work commences, the Contractor employees must notify the site manager and a permit to work must be issued to the Contractor’s employees for the day in which operations are to be carried out. The permit must be in writing and each part must be authorised by a suitably responsible person. All welding and cutting operations must cease at least one hour before vacating the site. Suitable and sufficient fire fighting equipment must be provided by the Contractor within close proximity of the work area. All employees should be suitably trained in its use. Noise At Work To comply with the Noise at Work Regulations, all Contractors must provide, maintain and ensure all of their employees wear suitable ear protection (where necessary) while working on site. The Contractor must inform the Establishment’s Site Manager and seek permission before work commences if the work involves producing excessive noise which could affect staff and the regime of the prison. Arrangements can then be made with the management of the affected area, and the appropriate action can be taken to minimise the risk to persons in the immediate and surrounding areas. Control Of Substances Hazardous To Health (COSHH) To comply with the Control of Substances Hazardous to Health, Contractors must provide written risk assessments and safety data sheets that must be available for his employees to see, of all substances used in his undertaking, which may effect the health of his employers, prison staff and visitors of the establishment and a copy of the assessments must be submitted to the Establishment’s Site Manager. Special Hazards Where Contractors operations are expected to create special hazards, i.e. in the application of heat, demolition work or use of dangerous articles or substances etc. The Contractor must inform the Establishment’s Site Manager so that arrangements can be made with the management of the affected area, and the appropriate action can be taken to minimise the risk to persons in the immediate and surrounding areas. Asbestos The Contractor should be aware that each Establishment has an ASBESTOS REGISTER which is held in the Site Manager’s office. This Register contains details of all known Asbestos within the Establishment. The Contractor should inspect the Register and if necessary take copies of any relevant work areas. After inspection the Contractor must sign a proforma in the Register, prior to the commencement of work. No work must be undertaken by Contractors involving the drilling, removing or disturbance of any asbestos based materials in any way, without the permission of the Establishments Site Manager. The Contractor’s personnel should be trained in Asbestos Awareness and on the discovery of a suspected Asbestos presence they must stop work immediately and seek the guidance of the Site Manager before continuance. The Contractor will not use any asbestos containing materials when carrying out any works within the establishment. Abrasive Wheels The Contractor must ensure that his employees who may use disc cutters have received information, instruction and training in the Abrasive Wheel Regulations, and have a valid certificate of competence in the procedure for changing of abrasive wheel discs. The Contractor must maintain a list of persons who have been trained and authorised to use disc cutters. Road Works Contractors who have been appointed to carry out works on roads and pathways on prison premises must ensure that they wear high visibility jackets or vests at all times and report their presence to the Establishments Site Manager before commencing the shift. To comply with the New Road and Street Works Act, any Contractors undertaking and executing street works involving the breaking up of the street, or on any drain or sewer, tunnelling or boring under the street, must ensure that the work is supervised by a person with the competence and qualifications to undertake the role of a supervisor.
