Excavations. In the event that there be an authorized excavation conducted upon lands adjacent to the Premises, Tenant shall allow the parties conducting same entry into the Office for the purpose of performing necessary work as such party deems necessary to shore up and/or preserve the wall of the Premises from damage including but not limited to supporting the existing exterior walls and foundations. Xxxxxx further agrees to waive any right Tenant may have to make a claim for damages caused thereby or indemnity therefore from that party or Landlord or for an abatement of Rent and/or Additional Rent.

Excavations. In case any excavation shall be made for buildings or improvements or for any other purpose upon the land adjacent to or near the Leased Premises, Tenant will afford to Landlord, or the person or persons, firms or corporations causing or making such excavation, license to enter upon the Leased Premises for the purpose of doing such work as Landlord or such person or persons, firms or corporations shall deem to be necessary to preserve the walls or structures of the building from injury, and to protect the building by proper securing of foundations. Insofar as Landlord may have control over the same, all such work shall be done in a manner as will not materially interfere with the operation of Tenant's business in the Leased Premises.
Excavations. The Contractor shall provide suitable and adequate shoring to the sides of excavations, where there is a danger of falls or dislodgement of the sides. In particular, the safety of pedestrians must be given priority and excavations must be boarded over, when work is not in progress. Barriers must be provided and illuminated where necessary, and the appropriate warning signs erected informing people of any danger. Excavations must be checked prior to entry at start of shift and a competent person must carry out a weekly inspection and the results recorded. Underground And General Services Before commencing on any excavation work, the Contractor must consult the Establishments Site Manager or his representative in order to find out the exact location of any underground services that may be present. The Contractor’s employees must be familiar with and have received information, instruction and training in the dangers of underground services, such as gas, electricity and water prior to commencing any work, and employees must be supervised. Detectors must be used to identify services. Power tools must not be used within 0.5 metres of the marked position and location of pipes, cables and ducts but the ground must be dug out by hand. Any damages made to services must be reported to the Establishments Site Manager or his representatives. Contractors must not connect or interfere with the water, gas, or electrical or other service without the permission of the Establishments Site Manager or his representative; connection of 110-volt portable electric tools is exempt from this rule. Mechanical Excavators, Mobile Cranes & Mobile Elevated Work Platforms Excavators, mobile cranes and mobile elevated work platforms must not be used on prison premises without the permission of the Establishments Site Manager and the Security Department and must be accompanied by a 12 monthly examination report, and valid test certificate. The machine must comply with the Provision and Use of Work Equipment Regulations. The safe working load must be clearly marked on the machine or a copy of the tables of safe working loads, bearing the identification number of the machine, must be clearly visible in the cab. The machine operator must be adequately trained and must hold a valid certificate of competence. Excavations a) An excavation permit will be obtained from BE&K or the client/owner before digging, no matter what the depth of the hole, trench or excavation. b) Protective systems such as trench boxes or shoring must be in place in all trenches five feet (5’) or more in depth unless benching or sloping in compliance with OSHA Standards is maintained. c) All subcontractor employees involved with trenching and excavations must be trained in the hazards and precautions. d) A competent person must inspect each trench daily prior to worker entry and intermittently during trenching operations. e) Spoil piles must be kept at least three (3) feet back from the edges of a trench. f) Safe access and egress into and out of trenches must be provided in every case.
