Exclusion of Non-recognized Organization. In those cases in which an employee elects to represent himself/herself or arranges for independent representation, the County shall make no settlement or award which shall be inconsistent with the terms and conditions of this Memorandum of Agreement. In the event the Association shall determine that such inconsistent award has been made, the Association, on its own behalf, may file a grievance pursuant to Paragraph C.3 of this Article for the purpose of amending such award. In the event any unrepresented or independently represented employee shall elect to go to arbitration under Paragraph D hereof, the Association may elect to be a full and equal part to such proceeding for the purpose of protecting the interests of its members in negotiated conditions of employment.
