Exclusion of Statutory Covenants. In the event that there is any inconsistency or conflict between the provisions contained in this Contract and the covenants implied or incorporated into the Civil Code of Québec, the provisions of this Contract shall have priority over and shall override those of the Civil Code of Québec to the extent of the inconsistency or conflict and provided such provision is not of public order under the Civil Code of Québec.
Exclusion of Statutory Covenants. The implied covenants deemed to be included in a charge under the Real Property Act shall be and are hereby expressly excluded and replaced by the terms of this Charge which are covenants by the Borrower, for and on behalf of the Borrower, with the Bank.
Exclusion of Statutory Covenants. The covenants implied or incorporated into a mortgage by statute in the province or territory in which your property is located, to the extent permitted by statute, are excluded or overridden by the terms of this mortgage.
