Exclusionary List. Purchaser may provide to Seller a proprietary exclusionary list (“List”) identifying individuals and companies (including but not limited to Borrower, seller, realtor, loan officer, broker, appraiser, closing agent, and underwriter) that are excluded from participating, either directly or indirectly, in Loans sold to Purchaser. Seller covenants that no Person included on the List will be involved in Loans that are sold by Seller to Purchaser after receiving the List. The List may be compiled from internal, Investor, and Insurer exclusionary lists, and is the Confidential Information of Purchaser. Seller, for itself and its current and former employees, agrees that it and they shall not distribute or share any information contained within the List with any third parties, including any Person identified on the List. Seller will take appropriate measures to ensure compliance with these requirements,and agrees to indemnify Purchaser for any loss, damage, or expense resulting from Seller’s failure to maintain the confidentiality of the List.

Registered Sex Offender Restrictions: For work to be performed at schools, Vendor agrees that no employee of Vendor or a subcontractor who has been adjudicated to be a registered sex offender will perform work at any time when students are, or reasonably expected to be, present unless otherwise agreed by the TIPS Member. Vendor agrees that a violation of this condition shall be considered a material breach and may result in the cancellation of the TIPS Sale at the TIPS Member’s discretion. Vendor must identify any additional costs associated with compliance of this term. If no costs are specified, compliance with this term will be provided at no additional charge. Safety Measures: Vendor shall take all reasonable precautions for the safety of employees on the worksite, and shall erect and properly maintain all necessary safeguards for protection of workers and the public. Vendor shall post warning signs against all hazards created by the operation and work in progress. Proper precautions shall be taken pursuant to state law and standard practices to protect workers, general public and existing structures from injury or damage. Smoking: Persons working under Agreement shall adhere to the TIPS Member’s or local smoking statutes, codes, ordinances, and policies.

  • Subproviders and Suppliers List Pursuant to requirements of 43 Texas Administrative Code §9.350 et seq., the Engineer must provide the State a list (Exhibit H-5/DBE or Exhibit H-6/HUB) of all Subproviders and suppliers that submitted quotes or proposals for subcontracts. This list shall include subproviders and suppliers names, addresses, telephone numbers, and type of work desired.

  • Seniority List The Employer shall maintain a seniority list showing the date upon which each employee's service commenced. An up-to-date seniority list shall be sent to the Union and posted on all bulletin boards in January of each year.
