Exclusions from Settlement. A. Any Person or Business in the Settlement Class may submit a request for exclusion from the Settlement on or before the Response Deadline.

Decisions of a Contracting Party taken in accordance with national legislation as to whether or not to permit establishment of a new business enterprise, or acquisition of an existing business enterprise or a share of such enterprise, by investors or prospective investors of the other Contracting Party shall not be subject to dispute settlement under Article of this Agreement.
Exclusions from Settlement. Claims meeting the above eligibility requirements are nevertheless not included in this settlement if the claim is not identified on the Eligible Claims List described in Section 1.1.4 of this Third Settlement Agreement. To be clear, this settlement is not open for general enrollment, and is limited to the specifically identified Eligible Claims.
