Excused Late Contribution. The General Partner may, for good cause determined in the sole discretion of the General Partner, permit a Limited Partner to have up to ten Business Days after the date of a scheduled Drawdown with which to make its Capital Contribution. Without limiting the General Partner’s discretion, this additional time is intended for the benefit of Limited Partners who provide advance notice to the General Partner of an upcoming extended vacation or other absence. In these cases, the Capital Contribution will be due promptly following the Limited Partner’s return, and in all events within ten Business Days after the scheduled date of the Drawdown. The General Partner may, in its sole and absolute discretion, refrain from calling an Event of Default by reason of a Limited Partner’s failure to make a Capital Contribution by the scheduled date of the Drawdown, for good reason as determined by the General Partner. In all cases in which the General Partner permits a Limited Partner to have additional time within which to make a Capital Contribution, the unpaid amount will bear interest at a rate equal to the Preferred Return from the scheduled date of the Drawdown until the amount is paid to the Fund.

  • How Do I Correct an Excess Contribution? If you make a contribution in excess of your allowable maximum, you may correct the excess contribution and avoid the 6% penalty tax for that year by withdrawing the excess contribution and its earnings on or before the date, including extensions, for filing your tax return for the tax year for which the contribution was made (generally October 15th). Any earnings on the withdrawn excess contribution may also be subject to the 10% early distribution penalty tax if you are under age 59½. In addition, although you will still owe penalty taxes for one or more years, excess contributions may be withdrawn after the time for filing your tax return. Excess contributions for one year may be carried forward and applied against the contribution limitation in succeeding years. An individual who is partially or entirely ineligible to make contributions to a Xxxx XXX may transfer amounts of up to the yearly contribution limits to a non-deductible Traditional IRA (subject to reduction for amounts remaining in the Xxxx XXX plus other Traditional IRA contributions).

To the extent that your contribution exceeds the deductible limits, it will be nondeductible. However, earnings on all IRA contributions are tax deferred until distribution. You must designate on your federal income tax return the amount of your Traditional IRA contribution that is nondeductible and provide certain additional information concerning nondeductible contributions. Overstating the amount of nondeductible contributions will generally subject you to a penalty of $100 for each overstatement.
