Existing Environmental Reports. Tenant hereby acknowledges that it has received, read and reviewed the reports and test results described in Exhibit "D" attached hereto and made a part hereof (the "Existing Environmental Reports").

Existing Environmental Reports. Seller will, within 5 days after the Effective Date, provide to Purchaser copies of all reports, studies, and other materials which Seller possesses or controls which pertain to the environmental condition of the Property and the property Seller owns in the vicinity of the Property (collectively, the “Existing Environmental Reports”) in accordance with Section 4.01.
Existing Environmental Reports. Tenant hereby acknowledges that it has received, read and reviewed the reports and test results described in Exhibit "F" attached hereto and made a part hereof (the "EXISTING ENVIRONMENTAL REPORTS"). The Hazardous Materials currently present in, on or under the Premises or the soil, groundwater, surface water or air thereof, or in, on, or under any property in the vicinity of the Premises, or the soil, groundwater, surface water or air thereof, as described in the Existing Environmental Reports are referred to herein as the "EXISTING ENVIRONMENTAL CONDITION". Tenant shall keep the Existing Environmental Reports and all information contained therein confidential, except Tenant shall be allowed to disclose such information to Tenant's consultants and attorneys provided such parties agree to keep the information confidential.
Existing Environmental Reports. Buyer acknowledges that Seller has provided to Buyer the environmental reports and information relating to the Property that are identified and described in EXHIBIT E attached hereto ("Environmental Reports"). BUYER ACKNOWLEDGES THAT SELLER HAS PROVIDED THE ENVIRONMENTAL REPORTS AS A CONVENIENCE TO BUYER AND THAT BUYER IS NOT ENTITLED TO RELY UPON THE ENVIRONMENTAL REPORTS. It is expressly agreed that nothing herein shall be deemed to preclude Buyer from making its own environmental assessment of the Assets as provided in subsection (b) below. Buyer acknowledges and agrees that the submission of the Environmental Reports to Buyer are for informational purposes only and SELLER DOES NOT AND SHALL NOT MAKE ANY REPRESENTATION OR WARRANTY WHATSOEVER AS TO THE ACCURACY OF THE INFORMATION CONTAINED IN THE ENVIRONMENTAL REPORTS, THE COMPLETENESS OF THE REPORTS, OR THE ENVIRONMENTAL OR ANY OTHER CONDITION OF THE ASSETS OR OF THE COMPANY. Buyer further acknowledges that the Environmental Reports disclose that groundwater beneath the Property contain arsenic at levels above the Maximum Contaminant Level for arsenic promulgated pursuant to the Safe Drinking Water Act, 42 U.S.C. 300f through 300i. Buyer shall treat the Environmental Reports in a confidential manner and shall not disclose the existence or any aspect of the Environmental Reports to any third party without the prior written approval of Seller.
Existing Environmental Reports. LGI De shall include within the LGI De's Documents any existing environmental reports conducted, in connection with the environmental condition of the Property, including any environmental assessments and studies of the Property.

Tenant hereby acknowledges that it has received, read and reviewed the reports and test results described in EXHIBIT "E" attached hereto and made a part hereof (the "Existing Environmental Reports") The Hazardous Materials, if any, currently present in, on or under the Premises as described in the Existing Environmental Reports are referred to herein as the "Existing Environmental Conditions"). Tenant shall not be responsible for remediating any Existing Environmental Condition unless Tenant exacerbates any Existing Environmental Condition.
Existing Environmental Reports. The Owner shall furnish to the Architect for its use any chemical, air and water pollution tests, tests for hazardous materials, other laboratory and environmental tests, evaluations and analyses in the Owner’s possession or that come into its possession.

Except as disclosed in the Existing Environmental Reports, Landlord represents that it has no knowledge of (i) the presence of any Hazardous Materials on the Premises or the soil surface, water or groundwater thereof, (ii) the presence of any underground storage tanks on the Premises, or (iii) any action, proceeding or claim pending or threatened with respect to any Hazardous Materials on or about the Premises. Landlord has in its possession no environmental report relating to the Premises other than the Existing Environmental Report.
