Expansion of Leased Premises. (a) Commencing on September 1, 2007 (the "Expansion Date"), the Leased Premises shall be automatically expanded to include approximately twenty-six thousand seventy-two (26,072) square feet of Net Rentable Area on Xxxxx 00 of the Building, as shown on Exhibit A attached hereto and made a part hereof (the "First Amendment Expansion Premises"); provided that, the Expansion Date shall occur (if at all) no earlier than the date upon which the Washington Mutual Lease Amendment (defined in Paragraph 10 hereof) has been executed, as set forth in Paragraph 10 of this Amendment. Upon the Expansion Date, the Leased Premises shall contain a total of seventy-seven thousand six hundred fifty-four (77,654) square feet of Net Rentable Area.
(b) The First Amendment Expansion Premises shall be added to and become part of the Leased Premises for all purposes of the Lease without any further action on behalf of Landlord or Tenant and shall be subject to all of the terms and conditions of the Lease applicable to the Leased Premises, including, without limitation, Tenant's obligation to pay Base Rental and Tenant's Basic Cost Adjustment in accordance with Article III of the Lease, subject to the modifications contained in this Amendment.
(c) The lease term for all of the First Amendment Expansion Premises shall commence upon the Expansion Date and shall expire on the date upon which the Lease expires as to the remainder of the Leased Premises, as extended by this Amendment.
(d) As used herein, "First Amendment Expansion Premises I" shall mean the portion of the First Amendment Expansion Premises containing seventeen thousand two hundred eighty-six (17,286) square feet of Net Rentable Area, and "First Amendment Expansion Premises II" shall mean the portion of the First Amendment Expansion Premises containing eight thousand seven hundred eighty-six thousand (8,786) square feet of Net Rentable Area. First Amendment Expansion Premises I and First Amendment Expansion Premises II collectively make up the First Amendment Expansion Premises.
Expansion of Leased Premises. Where the Broker procures a Tenant with an expressed need for additional facilities at a later date, and the Owner is so advised then in the event such additional facility is subsequently leased by said Tenant, an additional commission shall be payable by the Owner to the Broker, calculated at the usual leasing rates listed herein.
Expansion of Leased Premises. 16.1 Within five (5) business days of each anniversary or semi-anniversary of the Lease Commencement Date (i.e. every six (6) months following the Lease Commencement Date), Tenant shall provide written notice to Landlord of its need for additional office space for the upcoming Lease year in order to operate the semiconductor wafer fabrication business. Landlord shall use reasonable efforts to make such space, up to a maximum of 40,000 rentable square feet in the Building in the aggregate over the Lease Term (the "Additional Office Space") (which is in addition to the Leased Premises originally identified herein), available to Tenant when requested, provided that the following conditions shall apply:
(a) In the event Landlord needs to move employees in order to make any Additional Office Space available to Tenant, (1) Tenant shall pay all costs of moving and relocating such employees and (2) in the event Landlord is required to lease additional space to house such employees, Tenant shall pay fair market base rent (the determination of which shall take into account Tenant's obligation to pay Expense Rent hereunder) for the Additional Office Space or portion thereof corresponding to the additional space Landlord was required to lease to house such employees.
(b) Except as set forth in subparagraph (a) above, Additional Office Space shall be leased to Tenant upon the same terms and conditions contained in this Lease, provided that Tenant's Pro Rata Share in this Lease and the El Capitan Lease shall be adjusted accordingly to take into account the additional space leased to Tenant in the Building;
(c) Tenant shall not be entitled to sublease any of the Additional Office Space;
(d) Tenant is not then in default under any of the terms and conditions of this Lease; and
(e) Landlord and Tenant shall execute an amendment to this Lease to reflect the addition of the Additional Office Space on the terms set forth herein.
Expansion of Leased Premises. Commencing on the Expansion Date, the Leased Premises shall be expanded from the existing 50,323 Rentable Square Feet (the "Existing Space") to include an additional 12,620 Rentable Square Feet on Floor 20 of the Building (the "Expansion Space") as shown on Exhibit A attached hereto and made a part hereof, such that the total Rentable Square Feet contained within the Leased Premises as of the Expansion Date shall be 62,943 Rentable Square Feet. The Expansion Space shall be added to and become part of the Leased Premises for all purposes of the Lease and, except as expressly set forth herein, shall be subject to all of the provisions of the Lease as amended hereby, applicable to the Leased Premises, including, without limitation, Tenant's obligation to pay Rent.
Expansion of Leased Premises. Effective as of December 31, 2014 (the “Target Commencement Date”), the Original Premises shall be expanded so as to include: (i) the approximately 1,001 Rentable Square Feet commonly known as Suite 112 located on the first (1st) floor of the building located at 0000 Xxxxxxxxx Xxxxxxxxxx XX, Xxxxxxx, Xxxxxxx 00000 and shown on Exhibit “A-1” attached hereto and, by this reference, made a part hereof; and (ii) the approximately 22,827 Rentable Square Feet located on the third (3rd) floor of the building located at 0000 Xxxxxxxxx Xxxxxxxxxx XX, Xxxxxxx, Xxxxxxx 00000 and shown on Exhibit “A-2” attached hereto and, by this reference, made a part hereof (collectively, the “Second Expansion Premises”, which shall be known together with the Original Premises as the “Leased Premises”) in the Building so that, upon the Second Expansion Premises Commencement Date, the Rentable Area of the Leased Premises shall, for all purposes under the Lease, be conclusively deemed to be 54,880 Rentable Square Feet.
Expansion of Leased Premises. In addition to the Original Lease and Amendment I, in Amendment II parties agreed to increase the leased premises with ca.
Expansion of Leased Premises. Effective as of the date of “Substantial Completion” of the “Tenant Improvements” (both as hereinafter defined) (the “Third Expansion Premises Commencement Date”), which is estimated to occur on or about February 1, 2017 (the “Target Commencement Date”), the Original Premises shall be expanded so as to include the approximately 21,287 Rentable Square Feet commonly known as Suite 400 located on the fourth (4th) floor of the building located at 0000 Xxxxxxxxx Xxxxxxxxxx XX, Xxxxxxx, Xxxxxxx 00000 and shown on Exhibit “A” attached hereto and, by this reference, made a part hereof (the “Third Expansion Premises”, which shall be known together with the Original Premises as the “Leased Premises”) in the Building so that, upon the Third Expansion Premises Commencement Date, the Rentable Area of the Leased Premises shall, for all purposes under the Lease, be conclusively deemed to be 70,700 Rentable Square Feet.
Expansion of Leased Premises. Subject to and upon the terms, provisions and conditions hereinafter set forth and each in consideration of the duties, covenants and obligations of the other hereunder, Landlord does hereby lease to Tenant and Tenant does hereby lease from Landlord an additional 1,100 square feet of net rentable area on Floor 28 of the Building (the "EXPANSION PREMISES") as reflected on the floor plan of the Expansion Premises attached hereto and made a part hereof for all purposes as EXHIBIT A.
Expansion of Leased Premises. The Existing Leased Premises is hereby expanded by adding approximately 114 acres in Hood County, Texas (the “Second Expansion Leased Premises”) as shown in Exhibit “C” attached hereto. The term “Leased Premises” as used in the Lease Agreement means and shall include the Existing Leased Premises, the Expansion Leased Premises, and the Second Expansion Leased Premises. The lease of the Second Expansion Leased Premises is subject to all of the terms and conditions of the Lease Agreement currently in effect, except as modified in this Amendment.
Expansion of Leased Premises. Commencing on the date of the delivery of the applicable space to Tenant as provided below, the Leased Premises shall be expanded to include the following space (collectively, the "EXPANSION SPACE"):
(a) Approximately 6,127 square feet of Net Rentable Area located on Floor 31 of the Building as shown on EXHIBIT A-1 hereto (the "FIRST SPACE");
(b) Approximately 25,571 square feet of Net Rentable Area located on Floor 24 of the Building as shown on EXHIBIT A-2 hereto (the "SECOND SPACE");
(c) Approximately 143,355 square feet of Net Rentable Area located on Floors 25 through 29 and a portion of Floor 31 of the Building as shown on EXHIBIT A-3 hereto (the "THIRD SPACE"); and
(d) If, and only if, Tenant has exercised the Fourth Space Option, as defined below, approximately 16,356 square feet of Net Rentable Area located on Floor 9 of the Building as shown on EXHIBIT A-4 hereto (the "Fourth Space").
